What Is a Disciplinary Complaint Procuraduría General de la Nación Colombia?

The Disciplinary Complaint before the Procuraduría General de la Nación Colombia (Solicitud de Intervención ante la Procuraduría) is the formal mechanism through which any citizen, legal entity, or public institution reports to the State's disciplinary control body the alleged commission of disciplinary offenses by Colombian public servants in the exercise of their functions. The Procuraduría General de la Nación — established under Articles 277 through 280 of Colombia's 1991 Constitución Política and regulated by Ley 734 de 2002 (Código Disciplinario Único — CDU), recently updated by Ley 1952 de 2019 — is the highest-ranking body of the Ministerio Público branch and exercises superior oversight of the official conduct of all public servants.

The Procurador General de la Nación — elected by the Senado de la República from a list of three candidates submitted jointly by the Corte Suprema de Justicia, the Corte Constitucional, and the Consejo de Estado under Article 278 of the Constitución — holds sweeping constitutional powers including the authority to remove any public servant from office when they incur in one of the causes listed in Article 278 numeral 1. Disciplinary sanctions the Procuraduría may impose include: destitución e inhabilidad general (disqualification from public office for ten to twenty years for the most serious offenses under Article 44 CDU); suspensión en el cargo (suspension from office for up to twelve months); multa (fine of up to ninety days of the sanctioned person's salary); and amonestación escrita (written reprimand).

The disciplinary complaint before the Procuraduría activates the disciplinary process regulated in Title V of Ley 734 de 2002 (Articles 128 to 224): the Procuraduría evaluates the complaint, may initiate preliminary inquiry (indagación preliminar) or formal disciplinary investigation (investigación disciplinaria), gathers evidence, summons the investigated party, and issues a first-instance ruling appealable before the same body or before the Sala Disciplinaria. Corruption and abuse of authority: When a public servant — alcalde, gobernador, concejal, diputado, judge, fiscal, police officer, INPEC official, or employee of a territorial or national entity — engages in corrupt conduct: soliciting or receiving bribes in exchange for official acts (cohecho under Código Penal Articles 405-406); entering into contracts contrary to the law for personal benefit (contrato sin cumplimiento de requisitos legales under CDU Article 48 numeral 31); or using public resources for private purposes. Simultaneously with the disciplinary complaint, a criminal report before the Fiscalía General de la Nación may be warranted.

Dereliction of functional duties: When a public servant fails to perform their legal functions established in their job description, law, or applicable regulations: the healthcare entity official who denies urgent medical attention; the judge who unjustifiably delays proceedings; the police inspector who refuses to attend complaints; or the registry official who delays procedures without justification. The Sala Disciplinaria of the Consejo de Estado has held that dereliction of duty is a disciplinary offense even absent proof of corrupt intent.

Violation of the right to petition: Article 14 of the CPACA (Ley 1437 de 2011) establishes peremptory deadlines for responding to petitions: 15 business days for information requests, 10 business days for document requests. A public servant who fails to respond within these terms incurs a serious disciplinary offense under CDU Article 48 numeral 34. The complaint before the Procuraduría is the mechanism to demand compliance with these deadlines.

Conflicts of interest and nepotism: When a public servant intervenes in administrative or contractual actions in which they have a personal interest, or appoints relatives to positions under their supervision in violation of Ley 190 de 1995 (Estatuto Anticorrupción) and Article 126 of the Constitución, the complaint before the Procuraduría activates investigation for the conflict of interest offense under CDU Article 40 numeral 7.

Description of the disciplinary offense: A specific, documented account of the irregular conduct: what the public servant did or failed to do, when it occurred, where, how it affected the complainant or the general interest, and which disciplinary rule is considered infringed. Disciplinary offenses are typified in Articles 34 to 48 of the CDU: gravísimas (most serious, Article 48), graves (serious, Article 50), and leves (minor, Article 50 in conjunction with Article 43). The classification of the offense determines the applicable sanction.

Supporting evidence: Documents, certifications, screenshots of digital communications, audio or video recordings (consistent with evidentiary rules under Constitución Article 29), witness statements that can corroborate the reported facts, and any other relevant evidence in the complainant's possession. The Procuraduría has broad investigative powers to obtain additional evidence through the Ministerio de Justicia y del Derecho coordination channels.

Designation of competent authority: The Procuraduría dependency to which the complaint is addressed: Procuraduría General de la Nación (headquarters in Bogotá, Carrera 5 No. 15-80), Procuradurías Regionales (in departmental capitals), Procuradurías Provinciales (in intermediate cities), or Procuradurías Distritales (in Bogotá, Medellín, Cali, Barranquilla). Territorial jurisdiction is determined by where the events occurred.
