What Is a Cooperative Membership Form (Kenya)?

A Cooperative Membership Form in Kenya organises the details a party must supply for the purpose it serves.

Membership in a Kenyan cooperative society is the foundational legal relationship that entitles an individual to access the society's services — credit facilities in a SACCO, marketing services in an agricultural cooperative, or housing allocation in a housing cooperative — and to participate in the democratic governance of the cooperative through voting rights at General Meetings. Section 16 of the Co-operative Societies Act (Cap. 490) provides that a person becomes a member of a cooperative society upon admission in accordance with the society's by-laws and payment of the prescribed entrance fee and share capital.

The Cooperative Membership Form must be consistent with the eligibility criteria set out in the cooperative's registered constitution. Common eligibility criteria under Kenyan cooperative practice include: age of 18 years or above (consistent with the age of contractual capacity under the Law of Contract Act Cap. 23); a common bond with existing members — for agricultural cooperatives, this may be residence within a specific agricultural zone or cultivation of a particular crop; for SACCOs regulated by SASRA, it may be employment with a specific employer or membership of a defined professional group; and the absence of any ground of disqualification such as insolvency, criminal conviction, or a history of default with the same or a related cooperative.

Under the Co-operative Societies Act (Cap. 490) and the SACCO Societies Act No. 14 of 2008, cooperative membership carries both rights and responsibilities. Members have the right to attend and vote at general meetings (one member, one vote regardless of the number of shares held — the fundamental cooperative governance principle), to stand for election to the Committee of Management, to receive allocated surplus and patronage refunds, to access the services offered by the cooperative, and to inspect the books of accounts and register of members. Members' obligations include paying contributions and levies on time, complying with the society's by-laws and General Meeting resolutions, and participating in the governance of the society.

The requirement for a signed Cooperative Membership Form reflects the cooperative's obligation under the Co-operative Societies Act (Cap. 490) to maintain a register of members under Section 26. The register must contain each member's name, address, the date on which they became a member, the number of shares held, and the date of cessation of membership. A Cooperative Membership Form is needed when employees of a company or government institution join their employer's affiliated SACCO — for example, a Nairobi County Government employees' SACCO, a teachers' SACCO, a police officers' SACCO, or a bank employees' SACCO. The signed membership form initiates the payroll check-off arrangement and documents the member's consent to monthly contribution deductions from their salary.

A Cooperative Membership Form is required when a farmer in a coffee, tea, dairy, horticulture, or sugarcane cooperative wishes to formalise their membership and gain access to the cooperative's marketing services, inputs procurement programme, or revolving loan fund.
