What Is a Childcare Service Agreement (Hong Kong)?
A Childcare Service Agreement in Hong Kong records the terms the parties accept and the commitments each makes to the other.
The Social Welfare Department (SWD) is the primary regulator of childcare centres in Hong Kong under Cap. 243. Any person or organisation operating a child care centre — providing care for three or more children under the age of three, or for six or more children aged three to under six — must obtain a licence from the SWD under Section 9 of Cap. 243. The SWD imposes licence conditions covering minimum floor space per child, staffing qualifications (Certificate in Early Childhood Education or equivalent), staff-to-child ratios, hygiene standards, and programme requirements. The SWD conducts regular inspections and may suspend or cancel licences for non-compliance.
The Education Bureau (EDB) regulates kindergartens for children aged three to under six separately under the Education Ordinance (Cap. 279) and the Kindergarten Education Scheme (KES). Kindergartens joining the KES receive government funding and must provide free half-day kindergarten places to eligible children. Workers on continuous contracts (employed for four or more weeks, 18 or more hours per week) are entitled to statutory holidays under Section 39, annual leave under Section 41, and sick leave under Section 33 of Cap. 57. Mandatory Provident Fund (MPF) contributions under the Mandatory Provident Fund Schemes Ordinance (Cap. 485) apply to qualifying employees. Centres must obtain written parental consent for data collection, specify the purposes (enrolment administration, health monitoring, SWD reporting), and obtain separate consent for photographs and sharing developmental records with external parties. When Do You Need a Childcare Service Agreement (Hong Kong)?
