4. PROVIDER OBLIGATIONS

4.1 The Provider shall maintain registration with Tusla (Child and Family Agency) under the Child Care Act 1991 and shall comply with all applicable regulations, including the Child Care Act 1991 (Early Years Services) Regulations 2016 (S.I. No. 221 of 2016) and, where applicable, the Child Care Act 1991 (Early Years Services) (Childminding Services) Regulations 2024.

4.2 The Provider shall maintain appropriate adult-to-child ratios as required by Tusla regulations.

4.3 The Provider shall maintain a written complaints procedure and provide a copy to the Parent / Guardian on request.

4.4 The Provider shall comply with mandatory reporting obligations under the Children First Act 2015. All staff hold current Garda vetting clearance under the National Vetting Bureau (Children and Vulnerable Persons) Acts 2012–2016.

4.5 Personal data of children and parents is processed in accordance with the Data Protection Act 2018 and GDPR. A Privacy Notice will be provided on enrolment.

5. PARENT / GUARDIAN OBLIGATIONS

5.1 The Parent / Guardian shall notify the Provider promptly of any change in medical conditions, emergency contacts, or authorised collection persons.

5.2 The Parent / Guardian shall pay all fees on the due date. Overdue fees may result in suspension of the childcare place.

5.3 The Parent / Guardian shall collect the child by the agreed closing time. Late collection fees may apply at the Provider's current rate.

6. TERMINATION

Either party may terminate this Agreement by giving [Notice Period] written notice to the other. The Provider may terminate immediately in exceptional circumstances, including non-payment of fees or conduct endangering the safety of other children or staff.

7. GOVERNING LAW

This Agreement is governed by the laws of Ireland. Any dispute shall be subject to the jurisdiction of the Irish courts. Consumer rights under the Sale of Goods and Supply of Services Act 1980 are not affected.
