What Is a Image and Photography Rights Consent Colombia (Autorización de Uso de Imagen)?

The Image and Photography Use Authorization in Colombia is a written document by which a natural person — the image rights holder — grants express permission to a third party (a company, photographer, media outlet, advertising agency, NGO or private individual) to use their photograph, video, voice or physical likeness in specified media and for defined purposes. In Colombia, the right to one's own image is protected as a fundamental right derived from the constitutional right to privacy (Article 15 of the Political Constitution of 1991) and personal dignity (Article 1). The Constitutional Court of Colombia, in Judgment T-472 of 1996 and Judgment T-787 of 2004, recognized the right to one's own image as an autonomous fundamental right that prohibits its commercial exploitation without the explicit consent of the rights holder.

Law 23 of 1982 (Copyright Law) and Andean Community Decision 351 of 1993 (Common Regime on Copyright and Related Rights) protect the person's image as part of their personality rights (derechos de la personalidad). Article 87 of Law 23 of 1982 requires written authorization for the commercial reproduction of a person's photograph. The authorization must specify the scope of use: media (print, digital, television, social media), duration, territory and commercial or non-commercial nature of the use.

Law 1581 of 2012 (Habeas Data Law) and Decree 1377 of 2013 add a data protection dimension when the image is used in databases or digital platforms that constitute personal data treatment. In this context, the image use authorization also functions as the data subject's consent for personal data processing, and the data controller must register the database with the SIC's National Registry of Databases (Registro Nacional de Bases de Datos).

For minors under 18 years of age, image use authorization must be granted by their parents or legal guardians under Articles 14 and 23 of Law 1098 of 2006 (Childhood and Adolescence Code), and any use must serve the best interest of the child. When Do You Need a Image and Photography Rights Consent Colombia (Autorización de Uso de Imagen)?

The Image Use Authorization is required in Colombia in the following situations:

Advertising and marketing campaigns: Any commercial use of a person's image in print advertising, digital media campaigns, social media content, billboards, television commercials or promotional materials requires a signed authorization. Advertising agencies and their clients (brands, retailers, financial institutions) routinely use this authorization to document consent before publishing campaigns.

Corporate communications and websites: When companies use photographs of employees, executives, clients or third parties on their corporate websites, annual reports, investor presentations or LinkedIn profiles, a signed authorization from each person depicted is required under Law 1581 of 2012 and the copyright provisions of Law 23 of 1982.

Media and journalism: While the press has broader latitude to publish images of public figures in matters of public interest (Judgment T-040 of 2013 of the Constitutional Court), the commercial use of photographs taken at public events still requires authorization when the image is used for purposes other than news reporting — for example, stock photo libraries, brand endorsements or product placements.

Social media content and influencer marketing: Brands working with influencers and content creators in Colombia must obtain image authorizations before publishing sponsored content featuring the influencer's likeness. The Superintendencia de Industria y Comercio (SIC) has published guidelines on influencer marketing compliance under the consumer protection statute (Law 1480 of 2011) that require clear disclosure of commercial relationships.

Entertainment, film and photography productions: Film productions, television series, documentaries and photography projects operating in Colombia require signed image authorizations from all persons who appear in the content, whether as professional actors, extras or incidentally captured bystanders. The authorization must specify the distribution channels (theatrical release, streaming platforms, broadcast television) and territories.

Academic research and public health: Universities, research institutes and public health entities such as the Instituto Nacional de Salud require image authorizations when using photographs of research participants or patients in academic publications, conference presentations or public health campaigns.

The Image and Photography Use Authorization in Colombia must include the following elements to be legally valid:
