El PROMETIENTE VENDEDOR se compromete a vender y el PROMETIENTE COMPRADOR se compromete a comprar el siguiente vehículo automotor:

SEGUNDA — PRECIO Y ARRAS

El precio total acordado para la compraventa del vehículo es de [Precio Total] (pesos colombianos). A la firma de la presente promesa, el PROMETIENTE COMPRADOR entrega al PROMETIENTE VENDEDOR la suma de [Valor de Arras] a título de [Tipo de Arras], en los términos del artículo 1859 del Código Civil colombiano. El saldo del precio, es decir, la diferencia entre el precio total y las arras entregadas, será cancelado [Forma de Pago del Saldo].

TERCERA — PLAZO PARA EL CONTRATO DEFINITIVO

Las partes se comprometen a comparecer ante el organismo de tránsito competente o a suscribir el contrato definitivo de compraventa a más tardar el día [Plazo para Contrato Definitivo], fecha en la cual se perfeccionará el traspaso del vehículo en el RUNT (Registro Único Nacional de Tránsito), conforme a la Ley 769 de 2002 y el Decreto 1079 de 2015.

CUARTA — DECLARACIONES DEL PROMETIENTE VENDEDOR

El PROMETIENTE VENDEDOR declara bajo la gravedad de juramento que el vehículo objeto de la presente promesa: (a) es de su exclusiva propiedad y se encuentra debidamente inscrito en el RUNT; (b) se halla libre de prendas, embargos, gravámenes, limitaciones al dominio e inscripciones que afecten su libre disposición; (c) no tiene reportes de hurto, pérdida total o siniestro mayor en el sistema SIJIN/DIJIN; (d) no tiene multas de tránsito impagas ante ningún organismo de control; (e) se encuentra al día en el pago del impuesto sobre vehículos automotores (rodamiento) del año en curso; y (f) cuenta con SOAT (Seguro Obligatorio de Accidentes de Tránsito) vigente.

QUINTA — INCUMPLIMIENTO Y EFECTOS

En caso de incumplimiento del PROMETIENTE COMPRADOR, el PROMETIENTE VENDEDOR retendrá las arras entregadas. En caso de incumplimiento del PROMETIENTE VENDEDOR, deberá devolver al PROMETIENTE COMPRADOR el doble del valor de las arras recibidas, todo ello conforme al artículo 1859 del Código Civil. Sin perjuicio de lo anterior, la parte cumplida podrá exigir el cumplimiento forzoso del contrato ante la jurisdicción civil ordinaria.
