What Is a Volunteer Agreement (Singapore)?

A Volunteer Agreement in Singapore is a written document that sets out the terms and expectations between an organisation and an individual who provides services on a voluntary, unpaid basis. Unlike an employment contract governed by the Employment Act 1968 (Cap. 91), a Volunteer Agreement is specifically structured to avoid creating an employer-employee relationship, which means the volunteer is not entitled to statutory employment protections such as paid leave, CPF contributions, or overtime pay.

Singapore's volunteer sector is substantial. The National Volunteer and Philanthropy Centre (NVPC), operating under the Ministry of Culture, Community and Youth (MCCY), reported that approximately 22% of Singapore residents participate in formal volunteering each year. Organisations ranging from registered charities under the Charities Act (Cap. 37) to grassroots organisations, religious institutions, and event organisers engage volunteers for activities including community outreach, disaster relief coordination, event management, and administrative support.

While a Volunteer Agreement does not create contractual obligations enforceable in the same manner as an employment contract, Singapore courts have recognised that certain volunteer arrangements may give rise to obligations if the terms amount to a binding contract under Singapore contract law (based on English common law, received under the Application of English Law Act 1993). The critical distinction is whether the parties intended to create legal relations — a presumption that applies in commercial settings but is generally absent in social and voluntary arrangements. Organisations should draft volunteer agreements carefully to specify that no employment relationship or binding contractual obligation is intended.

A Volunteer Agreement differs from an internship agreement, a community service order, and a pro bono professional services arrangement. Interns may be covered by the Employment Act if they receive remuneration and perform work under the organisation's direction. Community service orders are court-directed obligations under the Criminal Procedure Code 2010. Pro bono services involve qualified professionals (lawyers, accountants, medical practitioners) donating their expertise, often with professional indemnity considerations governed by the relevant professional body — the Law Society of Singapore, the Institute of Singapore Chartered Accountants (ISCA), or the Singapore Medical Council (SMC).

The Personal Data Protection Act 2012 (PDPA) applies to organisations that collect personal data from volunteers. Section 13 of the PDPA requires organisations to obtain consent before collecting volunteers' personal data, and Section 24 mandates reasonable security arrangements to protect that data. The Personal Data Protection Commission (PDPC) has issued enforcement decisions against organisations that mishandled volunteer data, underscoring the importance of including PDPA compliance provisions in volunteer agreements. Under Singapore law, Section 169 of the Companies Act 1967 (Cap. 50) and Section 4 of the Stamp Duties Act (Cap. 312) govern the core requirements for this type of document.

When Do You Need a Volunteer Agreement (Singapore)?

A Volunteer Agreement is needed in Singapore whenever an organisation engages individuals to perform unpaid services, regardless of the organisation's size or the volunteer's role.

When a registered charity under the Charities Act (Cap. 37) recruits volunteers for ongoing programmes — such as meal delivery, tutoring, or befriending services for elderly residents — a written agreement clarifies the volunteer's role, time commitment, and the organisation's expectations. The Commissioner of Charities recommends that charities maintain clear documentation of their volunteer arrangements to support governance and accountability obligations.

When an event organiser or sports association engages volunteers for large-scale events such as the Singapore Marathon, National Day Parade, or community festivals, a Volunteer Agreement establishes duty hours, safety protocols, and the organisation's liability insurance coverage. The Workplace Safety and Health Act 2006 (WSHA) imposes a duty on persons who control workplaces to take reasonably practicable measures to protect anyone on the premises — including volunteers.

When a religious institution, social enterprise, or grassroots organisation invites volunteers to handle sensitive activities — working with children, elderly persons, or persons with disabilities — the agreement should address background screening requirements, safeguarding policies, and confidentiality obligations. The Children and Young Persons Act (Cap. 38) imposes reporting obligations on persons who have reason to believe a child is at risk of harm.

When an organisation provides volunteers with equipment, uniforms, access to premises, or reimbursement for transport and meals, a written agreement prevents ambiguity about whether the reimbursement constitutes remuneration that could trigger Employment Act coverage. The Ministry of Manpower (MOM) has stated that genuine out-of-pocket reimbursements do not convert a volunteer into an employee.

When volunteers are assigned tasks that involve access to the organisation's confidential information, donor records, or client personal data, a Volunteer Agreement incorporating confidentiality and PDPA compliance clauses protects the organisation and the individuals whose data is held. Under Singapore law, the common-law requirements for a valid contract — offer, acceptance, consideration, and intention to create legal relations — and Section 8 of the Employment Act 1968 (Cap. 91) govern the core requirements for this type of document.

What to Include in Your Volunteer Agreement (Singapore)

A well-drafted Singapore Volunteer Agreement should include the following elements to protect both the organisation and the volunteer.

Parties: The full legal name and Unique Entity Number (UEN) of the organisation, and the full name and NRIC or FIN number of the volunteer. Where the volunteer is under 18, a parent or guardian should co-sign the agreement.

Voluntary Nature: An express statement that the arrangement is voluntary, that no employment relationship is created, and that the volunteer is not entitled to wages, CPF contributions, leave, or other benefits under the Employment Act 1968 (Cap. 91). This clause is critical to prevent the agreement from being recharacterised as an employment contract.

Role and Responsibilities: A description of the volunteer's duties, reporting line, and the project or programme to which the volunteer is assigned. Specifying the scope of duties helps the organisation manage expectations and limits the volunteer's authority to act on the organisation's behalf.

Schedule and Duration: The expected days, times, and total hours of volunteering per week or month, the start date, and the anticipated end date (if applicable). Flexibility clauses should allow both parties to adjust the schedule by mutual agreement.

Reimbursements and Benefits: Whether the organisation will reimburse the volunteer for transport, meals, or other out-of-pocket expenses, and the process for submitting claims. The agreement should state that reimbursements are not wages and do not create an employment relationship.

Confidentiality: An obligation on the volunteer to keep the organisation's confidential information — including donor lists, client records, financial data, and operational plans — confidential during and after the volunteering period. Breaches of confidentiality may give rise to civil liability under common law or statutory liability under the PDPA 2012.

Data Protection: A clause addressing the organisation's obligations under the PDPA 2012, including how the volunteer's personal data will be collected, used, and stored, and the volunteer's consent to such processing. Where the volunteer handles third-party personal data (e.g., client or beneficiary records), the clause should set out the volunteer's data handling obligations. Organisations using forms-legal.com can customise PDPA clauses to reflect their specific data processing practices.

Safety and Insurance: A statement that the organisation will take reasonably practicable measures to protect the volunteer's safety in accordance with the Workplace Safety and Health Act 2006 (WSHA), and details of any personal accident insurance or public liability insurance covering volunteers.

Termination: Either party may end the arrangement at any time without notice or penalty, consistent with the voluntary and non-contractual nature of the relationship. The agreement should specify the return of organisation property (ID badges, equipment, keys) upon termination.

Governing Law: A statement that the agreement is governed by the laws of Singapore and that any disputes will be resolved through mediation (e.g., through the Singapore Mediation Centre) before recourse to the State Courts. Under Singapore law, Section 169 of the Companies Act 1967 (Cap. 50) and Section 4 of the Stamp Duties Act (Cap. 312) govern the core requirements for this type of document. Under Singapore law, the common-law requirements for a valid contract — offer, acceptance, consideration, and intention to create legal relations — and Section 13 of the Personal Data Protection Act 2012 (PDPA) govern the core requirements for this type of document.
