LANDSCAPING SERVICE CONTRACT / CONTRAT DE SERVICES D'AMÉNAGEMENT PAYSAGER

Le présent contrat de services d'aménagement paysager est régi par les articles 2098 à 2129 du Code civil du Québec (C.c.Q.) (contrat d'entreprise ou de service) et par la législation environnementale québécoise applicable, notamment la Loi sur les pesticides (RLRQ c P-9.3).

2. PORTÉE DES TRAVAUX

2.1 Immeuble : [Property Address].

2.2 Services : [Service Types]. Description détaillée : [Work Description]

2.3 Fréquence des services : [Service Frequency].

2.4 L'Entrepreneur exécutera tous les services en bon ouvrier, avec des matériaux et de l'équipement appropriés, conformément à l'art. 2100 C.c.Q. Lorsque des travaux peuvent exiger une licence d'entrepreneur RBQ (p. ex. murs de soutènement de qualité construction, systèmes de drainage), l'Entrepreneur confirme détenir les licences applicables.

2.5 Utilisation de pesticides / herbicides : [Pesticides Use]. Toute application de pesticides doit être conforme à la Loi sur les pesticides (RLRQ c P-9.3) et à la Loi sur la qualité de l'environnement du Québec.

3. PRIX ET PAIEMENT

3.1 Prix du contrat : [Contract Price] (CAD), taxes applicables en sus (TPS/TVQ).

3.2 Modalités de paiement : [Payment Terms]. Toute modification dépassant la portée initiale exige un avenant écrit signé par les deux parties avant le début des travaux supplémentaires (art. 2104 C.c.Q.).

3.3 Annulation / résiliation : [Cancellation Notice]. En vertu de l'art. 2125 C.c.Q., le Client peut résilier en tout temps moyennant un préavis raisonnable, sous réserve du paiement des services rendus et des dépenses raisonnables déjà engagées par l'Entrepreneur.

4. GARANTIE ET RESPONSABILITÉ

4.1 Garantie de l'ouvrage : l'Entrepreneur garantit tous les travaux contre les vices d'exécution pendant 90 jours à compter de l'achèvement, conformément à l'art. 2100 C.c.Q.

4.2 Garantie des végétaux : [Plant Warranty]. La garantie des végétaux s'applique uniquement lorsque le Client a suivi les directives d'entretien de l'Entrepreneur et qu'aucun événement météorologique extraordinaire (gel extrême, sécheresse, inondation) n'est survenu.

4.3 L'Entrepreneur détient une assurance responsabilité civile générale commerciale. Une preuve d'assurance est disponible sur demande. L'Entrepreneur n'est pas responsable des conditions préexistantes, des dommages causés par le Client ou des tiers, ni des cas de force majeure.

4.4 La présente entente est régie par les lois de la province de Québec (Code civil du Québec).
