What Is a Plumbing Contract (New Zealand)?

A Plumbing Contract in New Zealand records the plumbing work to be provided, the fees, the service standards, and each party's obligations between the provider and the client under the Plumbers, Gasfitters, and Drainlayers Act 2006.

In New Zealand, plumbing contracts are governed by several key statutes. The Plumbers, Gasfitters, and Drainlayers Act 2006 (PGD Act 2006) is the primary legislation governing the licensing and practice of plumbers, gasfitters, and drainlayers. Under section 10 of the PGD Act 2006, it is an offence to carry out, or to employ another person to carry out, sanitary plumbing, gasfitting, or drainlaying without a current practising licence issued by the Plumbers, Gasfitters, and Drainlayers Board (PGDB). The PGDB maintains a public register of all licensed practitioners at pgdb.govt.nz. The Construction Contracts Act 2002 (CCA 2002) governs the payment regime for plumbing contracts, including the right to make payment claims under section 20 and the mandatory adjudication process for payment disputes under Part 3. The Building Act 2004 — specifically section 40 — sets out building consent requirements for plumbing work forming part of building work, and the New Zealand Building Code (NZBC) — which is Schedule 1 to the Building Regulations 1992 — sets performance standards for plumbing installations including hot water (Clause G11), cold water (Clause G12), and foul water drainage (Clause G13).

Plumbing contracts in New Zealand cover a wide range of work: complete plumbing fit-out for new residential dwellings, bathroom and kitchen renovations, hot water cylinder replacement, installation of water treatment systems, connection to town water supply or wastewater systems, and specialised plumbing for commercial kitchens, healthcare facilities, and industrial processes. Where plumbing work includes gasfitting — such as installation of gas appliances, gas piping, or gas connection — a separate PGDB gasfitting practising licence is also required, and the gasfitter must issue a Certificate of Compliance after completing work.

New Zealand plumbers must also hold a current LBP (Licensed Building Practitioner) licence in the Plumbing category if their work constitutes restricted building work under the Building Act 2004. Restricted building work in the plumbing category includes installations that directly affect the weathertightness, structural integrity, or fire rating of a building. The relevant Building Consent Authority (BCA) will inspect plumbing as part of the consent process and will issue a Code Compliance Certificate (CCC) only when all work meets the NZBC standards.

Health and safety obligations under the Health and Safety at Work Act 2015 (HSWA 2015) apply to all plumbing contractors. WorkSafe New Zealand oversees compliance with HSWA 2015 on construction and plumbing sites, and notifiable incidents must be reported under Section 56 of the HSWA 2015. Under New Zealand law, Section 10 of the Plumbers, Gasfitters, and Drainlayers Act 2006 prohibits unlicensed plumbing work, Section 40 of the Building Act 2004 sets out when building consent is required, and Section 20 of the Construction Contracts Act 2002 establishes the statutory payment claim regime. The forms-legal.com Plumbing Contract (New Zealand) provides a thorough template covering all applicable licensing, consent, and payment obligations under New Zealand law.

When Do You Need a Plumbing Contract (New Zealand)?

A Plumbing Contract in New Zealand is appropriate whenever a property owner, developer, or building contractor engages a licensed plumber or plumbing company for significant plumbing work. Use cases include: new build plumbing fit-out for residential or commercial developments; full bathroom or kitchen renovations; hot water cylinder installation or replacement; connection to town water supply or wastewater network; installation of a rainwater harvesting or water treatment system; commercial or industrial plumbing projects; and re-piping of older buildings with deteriorated copper or galvanised iron pipes.

A written Plumbing Contract is particularly important where: the project involves multiple stages — typically rough-in plumbing before linings are installed, and fit-off after linings; gasfitting is included, requiring a separate PGDB gasfitting practising licence; a building consent from the BCA is required under Section 40 of the Building Act 2004, meaning the plumber must produce plans and specifications and obtain sign-off at inspection stages; the project value exceeds NZD 5,000; or the project is part of a broader construction contract governed by the Construction Contracts Act 2002.

Without a written contract, disputes about scope, pricing, NZBC compliance, warranty obligations, and payment are common. New Zealand residential plumbing disputes frequently relate to hot water temperature compliance under NZBC Clause G11, inadequate drainage falls under Clause G13, and unauthorised substitution of specified fixtures or fittings. A clear Plumbing Contract with a detailed scope referencing the BCA-approved plans, NZBC performance clauses, and the PGDB licence numbers of all practitioners eliminates ambiguity and protects the client if defects arise.

For plumbing work forming part of a larger building project, the Plumbing Contract is typically structured as a subcontract under the head building contract. The Construction Contracts Act 2002 subcontract provisions apply, including payment claim rights under section 20 and adjudication rights under Part 3. Disputes adjudicated under the CCA 2002 produce binding determinations enforceable as judgments of the District Court of New Zealand, making adjudication a practical and cost-efficient remedy for plumbing payment disputes. The Disputes Tribunal (under the Disputes Tribunal Act 1988) provides an alternative forum for smaller claims up to NZD $30,000 between a homeowner and a plumber.

What to Include in Your Plumbing Contract (New Zealand)

A thorough Plumbing Contract (New Zealand) should include the following key elements to comply with the Plumbers, Gasfitters, and Drainlayers Act 2006, Construction Contracts Act 2002, and Building Act 2004.

Party identification: Full legal names of the client and the plumber or plumbing company, NZBN, GST registration number, PGDB practising licence number and category (sanitary plumbing, gasfitting, drainlaying), and LBP licence number in the Plumbing category where restricted building work is involved. The PGDB licence number should be verified against the PGDB public register at pgdb.govt.nz before work commences.

Site address and consent details: The full address of the property, the building consent number issued by the Building Consent Authority (BCA), the BCA's name, and the inspection stages required by the BCA for the plumbing work. Where consent is not yet issued, the contract should record the consent application number and the obligation to obtain consent before commencing work.

Scope of plumbing works: A detailed, itemised description of all plumbing works referencing the BCA-approved plans and specifications. The scope must distinguish clearly between rough-in works (before linings) and fit-off works (after linings) if both stages are included. Variations to scope must be agreed in writing and priced before work proceeds.

Gasfitting scope: If gasfitting is included, the scope of gas work must be separately described, with the gasfitting practising licence number noted. The gasfitter's obligation to issue a Certificate of Compliance after completing gasfitting work must be recorded. Gasfitting must comply with AS/NZS 5601.1 (Gas Installations — Part 1: General Installations) as adopted in New Zealand.

NZBC compliance: Confirmation that all plumbing installations will comply with the New Zealand Building Code (NZBC) — specifically Clause G11 (Hot Water), Clause G12 (Water Supplies), and Clause G13 (Foul Water) — and that tempering valves will be installed where required under G11 to limit hot water outlet temperatures to 55°C at vulnerable-person outlets.

Contract price and GST: The total price in NZD inclusive of GST at 15% under the Goods and Services Tax Act 1985, or if quoted exclusive of GST the GST component stated separately. Whether the price is lump sum, schedule of rates, or cost plus.

Payment terms: Deposit, progress payment milestones structured as payment claims under section 20 of the Construction Contracts Act 2002, the client's obligation to issue payment schedules under section 21, due dates, and default interest. If the client fails to issue a payment schedule within the statutory timeframe, the full claimed amount becomes a debt due and payable.

Programme: Commencement date, estimated completion dates for each stage, and any dependencies on other trades or BCA inspections.

Workmanship warranty: Warranty period (typically 2 years), scope of warranty, and the plumber's obligation to rectify defects promptly on notification. The warranty must not exclude defects caused by non-compliant materials or workmanship that fails to meet NZBC performance standards.

PGDB certificate of compliance: The plumber's obligation to provide all required PGDB compliance documentation upon completion, including the certificate of compliance for sanitary plumbing and the Certificate of Compliance for gasfitting.

Health and safety: Obligations under the Health and Safety at Work Act 2015 (HSWA 2015), including notification to WorkSafe New Zealand under section 56 of the HSWA 2015 for notifiable incidents on site. The plumber, as a Person Conducting a Business or Undertaking (PCBU), must manage all foreseeable health and safety risks.

Dispute resolution: Adjudication under Part 3 of the Construction Contracts Act 2002, with determinations enforceable as judgments of the District Court of New Zealand. For smaller disputes, the Disputes Tribunal (Disputes Tribunal Act 1988) provides an accessible alternative for claims up to NZD $30,000.
