What Is a Workplace Safety Assessment (Hong Kong)?

A Workplace Safety Assessment in Hong Kong sets out the information or analysis it captures for compliance or operational use.

Section 6 of Cap. 509 requires every employer to take all reasonably practicable steps to protect employees from workplace risks. The Labour Department enforces Cap. 509 through unannounced workplace inspections under Section 8, improvement notices under Section 22 requiring remediation within a specified period, and prohibition notices under Section 24 that can immediately halt operations at a dangerous workplace. Failure to comply with the general duty under Section 6 carries a maximum penalty of HK$200,000 on first conviction and HK$500,000 on subsequent conviction. Failure to comply with an improvement notice carries an additional fine of HK$200,000 and up to 12 months' imprisonment.

While Hong Kong does not have a regulation equivalent to the UK's Management of Health and Safety at Work Regulations 1999 that explicitly requires every employer to conduct and document a formal written risk assessment, the Labour Department's Codes of Practice issued under Cap. 509 consistently recommend formal hazard identification and risk assessment as the basis of a safe system of work. The Codes of Practice are expressly admissible in evidence in proceedings under Cap. 509 — an employer who cannot demonstrate that they identified and assessed workplace risks will face extreme difficulty in showing that they took all reasonably practicable steps to manage those risks. A documented Workplace Safety Assessment is the most effective way to demonstrate this compliance.

For specific hazard categories, formal written assessments are effectively mandatory in Hong Kong: noise assessments under the Factories and Industrial Undertakings (Noise at Work) Regulation (Cap. 59 sub-legislation); manual handling assessments for roles involving heavy lifting; chemical hazard assessments applying COSHH-equivalent principles for workplaces using solvents, cleaning agents, or industrial chemicals; and workplace violence risk assessments for customer-facing service industry roles. Industrial undertakings regulated under the Factory and Industrial Undertakings Ordinance (Cap. 59) face additional and more prescriptive requirements than general workplaces, and certain employers in designated industries must appoint a qualified Occupational Safety Officer (OSO) under the Occupational Safety Officers Ordinance.

The Employees' Compensation Ordinance (Cap. 282) requires every employer to maintain valid employees' compensation insurance for all employees under Section 40. When Do You Need a Workplace Safety Assessment (Hong Kong)?

A Workplace Safety Assessment (Hong Kong) is needed in a range of situations that trigger the employer's obligation to review and manage workplace risks under the Occupational Safety and Health Ordinance (Cap. 509) and the Employees' Compensation Ordinance (Cap. 282).

New workplace setup: Before employees commence work at a new premises — whether a new office, factory, warehouse, construction site, retail outlet, or laboratory — a formal safety assessment should be completed before any work begins. This establishes the baseline risk profile, identifies the control measures required before employees are exposed to any hazards, and demonstrates to the Labour Department (if inspected from day one) that the employer conducted a proactive risk review. The Labour Department's inspectors may conduct unannounced visits to any workplace under Section 8 of Cap. 509, and employers who cannot produce evidence of hazard identification face significant enforcement risk.

Following a workplace accident or near-miss: Under Section 14 of the Employees' Compensation Ordinance (Cap. 282), all workplace accidents causing incapacity for more than three days must be reported to the Commissioner for Labour within 14 days using Form LD 54. Fatal accidents and accidents requiring hospitalisation must be reported immediately by telephone followed by a written report. Every reportable accident should trigger a formal review of the relevant risk assessment sections, a root cause investigation, and implementation of corrective control measures. Failure to review and update the risk assessment after a reportable accident is treated by the Labour Department as evidence of an inadequate safety management system — and can affect the employer's position in subsequent employees' compensation proceedings under Cap. 282.

Annual review cycle: The Labour Department's Codes of Practice issued under Cap. 509 recommend that risk assessments be reviewed at least annually. Many Hong Kong employers align their annual risk assessment review with their OSH management system audit cycle, their employees' compensation insurance renewal date, or the company's annual general management review. Annual review keeps the assessment current and reflects any operational changes that occurred during the year.

Significant changes to the workplace: Any significant change to premises, processes, equipment, chemical substances used, staffing levels, or working hours triggers an obligation to review the risk assessment. Common triggers include office refurbishments or relocation, installation of new plant or machinery, introduction of new chemical substances or industrial processes, changes to shift patterns or working hours, significant increase in employee numbers, or expansion into new areas of the premises including previously unoccupied floors or storage areas.

New high-risk activities: Starting activities that carry a materially elevated risk — working at height under the Factories and Industrial Undertakings (Safety Management) Regulation, operating heavy lifting equipment, handling hazardous chemicals subject to COSHH-equivalent controls, working in confined spaces, or undertaking excavation or demolition work — requires a specific, activity-level risk assessment before the activity commences. General workplace risk assessments typically do not capture the detail of activity-specific hazards at the granularity required for effective control of high-risk tasks.

Following a Labour Department improvement notice or prohibition notice: When a Labour Department inspector identifies a breach of Cap. 509 and issues an improvement notice under Section 22 of Cap. 509, the employer must comply within the stated period. A revised risk assessment documenting the corrective measures implemented is typically required to demonstrate compliance to the inspector and to satisfy the notice. A prohibition notice under Section 24 of Cap. 509 can immediately stop work at the premises until the risk is rectified — a revised risk assessment is central to the process of lifting the notice.

What to Include in Your Workplace Safety Assessment (Hong Kong)

A Hong Kong Workplace Safety Assessment should include the following elements to satisfy the Labour Department's requirements and demonstrate compliance with Cap. 509.

Company and workplace details: Legal name of the employer, business registration number, address of the workplace being assessed, the industry type, and the number of employees at the location. Industry type is relevant because different industries attract different specific regulations — for example, Cap. 59 for factories and industrial undertakings applies additional requirements beyond the general Cap. 509 duty.

Hazard identification by category: A systematic identification of hazards across all relevant categories for the workplace — physical hazards (noise, vibration, temperature extremes, lighting), ergonomic hazards (manual handling, display screen equipment, repetitive tasks), chemical hazards (solvents, cleaning agents, paints, dusts), biological hazards (in healthcare, laboratory, or food handling environments), psychosocial hazards (workplace violence risk in customer-facing roles, work-related stress), and electrical and fire hazards.

Risk level assessment: For each identified hazard, an assessment of likelihood and severity, producing an overall risk rating — commonly expressed as low, medium, high, or very high. A risk matrix approach, as recommended in the Labour Department's OSH guidance, provides a structured and defensible methodology.

Existing control measures: Documentation of control measures already in place for each hazard, assessed against the hierarchy of controls — elimination, substitution, engineering controls, administrative controls, and personal protective equipment (PPE).
