BACKGROUND

A. The Client wishes to engage the Plumber to perform the plumbing services described in this Contract at the premises specified.

B. The Plumber is a licensed plumbing contractor in [Plumber Licence State] and has agreed to perform those services on the terms and conditions set out in this Contract.

C. All plumbing work in Australia must be performed by a person who holds a valid plumbing licence issued by the relevant state or territory licensing authority. The issuing of compliance certificates for notifiable plumbing work is required by law.

D. This Contract is intended to comply with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the Work Health and Safety Act 2011 (Cth) and applicable state or territory equivalents, and the general law of [Governing State].

NOW, THEREFORE, the Parties agree as follows:

1. PLUMBING SERVICES

1.1 The Plumber agrees to perform [Work Type] at [Premises Address] (the “Premises”) on a [Urgency Type] basis.

1.2 The scope of plumbing work to be performed is as follows:

1.3 The Plumber will perform all services: (a) with due care and skill; (b) in accordance with the applicable Australian Plumbing Code (including AS/NZS 3500 National Plumbing and Drainage Standard); (c) in compliance with all applicable state or territory plumbing and drainage legislation and regulations; and (d) consistent with the consumer guarantees implied by sections 60 to 62 of the Australian Consumer Law.

1.4 Any variation to the scope of work must be agreed in writing by the Parties before the varied work is commenced. The Plumber will provide the Client with a written quotation for any proposed variation. Verbal instructions for out-of-scope work will not be acted upon without written confirmation.

1.5 If, during the performance of the services, the Plumber identifies additional defects or issues not included in the original scope, the Plumber will notify the Client in writing and obtain written approval before proceeding with any additional work.

2. LICENSING AND COMPLIANCE CERTIFICATES

2.1 The Plumber warrants that it holds a current and valid plumbing licence number [Plumber Licence Number] issued in [Plumber Licence State] and that this licence authorises the performance of the work described in this Contract. The Plumber will maintain a valid licence for the duration of this Contract.

2.2 The Plumber will carry out all notifiable plumbing and drainage work in accordance with the applicable state or territory plumbing and drainage legislation and will ensure that all required inspections are arranged and completed.

3. FEES AND PAYMENT

3.1 In consideration for the performance of the plumbing services, the Client shall pay the Plumber [Fee Amount] on [Fee Structure] basis. All fees are [GST Treatment].

3.2 The Plumber will issue a valid tax invoice upon completion of each stage of work or as otherwise agreed. Each tax invoice will include the Plumber’s ABN and comply with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

3.3 The Client must pay each invoice within [Payment Terms] days of the invoice date by electronic funds transfer to the Plumber’s nominated bank account.

3.4 If any invoice remains unpaid after the due date, the Plumber may: (a) charge interest at 10% per annum on the overdue amount, calculated daily; and (b) suspend further work on 2 business days’ written notice until all outstanding amounts are paid.

3.5 For time and materials or hourly rate engagements, the Plumber will provide the Client with a written estimate of the anticipated cost before commencing work. The actual cost may vary from the estimate. The Plumber will notify the Client if actual costs are likely to exceed the estimate by more than 10%.

3.6 Parts and materials supplied by the Plumber will be charged at cost plus a reasonable mark-up. The Plumber will obtain the Client’s approval before incurring any materials expenditure exceeding $500 (AUD) that was not included in the original scope.

4. WARRANTY

4.1 The Plumber warrants that all work performed under this Contract will be: (a) carried out in a good and workmanlike manner; (b) in compliance with all applicable laws, codes, and standards; and (c) using materials that are new, fit for purpose, and of acceptable quality.

4.2 The Plumber will rectify, at no additional cost to the Client, any defect in workmanship notified by the Client within [Warranty Period] months of the date of completion. This warranty does not cover: (a) defects caused by the Client, third parties, or misuse; (b) fair wear and tear; or (c) damage caused by a failure to maintain the plumbing system.

4.3 Parts and fixtures supplied by the Plumber are subject to the manufacturer’s warranty, which the Plumber will pass through to the Client. The Plumber will assist the Client to make a manufacturer warranty claim where reasonably possible.

4.4 Nothing in this clause limits or excludes any consumer guarantee implied by the Australian Consumer Law that cannot lawfully be excluded.

5. INSURANCE AND WORK HEALTH AND SAFETY

5.1 The Plumber must maintain throughout the term of this Contract: (a) public liability insurance with a minimum cover of $10,000,000 (AUD) per occurrence; (b) where applicable, workers’ compensation insurance as required by the applicable state or territory legislation.

5.2 The Plumber must provide evidence of current insurance certificates within 5 business days of the Client’s written request.

5.3 The Plumber must comply with the Work Health and Safety Act 2011 (Cth) and applicable state or territory WHS legislation in performing all work at the Premises. The Plumber is responsible for the health and safety of its employees, subcontractors, and agents while on site.

5.4 The Client must disclose all known hazards at the Premises before work commences, including the presence of asbestos-containing materials, lead pipes, restricted access areas, or other safety risks.

6. AUSTRALIAN CONSUMER LAW

6.1 Nothing in this Contract excludes, restricts, or modifies any right, remedy, guarantee, warranty, or other term implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited.

6.2 To the maximum extent permitted by law, the Plumber’s aggregate liability to the Client for any claim arising under or in connection with this Contract is limited to the total fees paid by the Client under this Contract or $20,000 (AUD), whichever is lesser.

6.3 Neither Party is liable for any indirect, special, or consequential loss arising under or in connection with this Contract, to the maximum extent permitted by law.

7. TERMINATION

7.1 The Client may request cancellation of scheduled (non-urgent) work by providing written notice to the Plumber at least 24 hours before the scheduled commencement time. If less than 24 hours’ notice is provided, a reasonable cancellation fee equivalent to 50% of the estimated fee may be charged.

7.2 Either Party may terminate this Contract immediately by written notice if the other Party commits a material breach that is not remedied within 7 days of written notice requiring remedy, or if the other Party becomes insolvent.

7.3 On termination for any reason, the Client must pay all fees for work completed and materials supplied up to the effective date of termination.

8. GENERAL PROVISIONS

8.1 Entire Agreement: This Contract constitutes the entire agreement between the Parties with respect to the plumbing services and supersedes all prior representations and agreements.

8.2 Amendments: This Contract may only be amended by a written instrument signed by both Parties.

8.3 Independent Contractor: The Plumber is an independent contractor and not an employee of the Client.

8.4 Dispute Resolution: If a dispute arises, the Parties must attempt good-faith negotiation within 14 days of written notice. If unresolved, either Party may refer the matter to the applicable state or territory consumer protection authority or to mediation before commencing legal proceedings.
