This Roommate Agreement (the "Agreement") is entered into on [Effective Date](the "Effective Date") by and between

WHEREAS there is a lease agreement dated [Address](the "Lease Agreement"), provided herein in the Annex, concluded on [City] with landlord [Landlord's name] (the "Beginning Date") and ending on [State](the "End Date") with [ZIP Code](the "Landlord") for the premises located at [Name](the "Premises");

WHEREAS the Parties, having agreed to be bound by the terms of the Lease Agreement and decided to share the Premises as co-tenants, now wish to establish additional rules and arrangements for their living situation;

WHEREAS the Parties recognize the importance of clearly defining their rights, responsibilities, and expectations to maintain a peaceful and cooperative living environment;

NOW, THEREFORE, in consideration of the mutual promises and obligations set forth herein, and upon other good and valuable considerations, the receipt and sufficiency of which is hereby acknowledged, the Parties have agreed as follows:

SUBJECT OF THE AGREEMENT. The subject of this Agreement is the rules of cohabitation in the shared Premises located at [Address]. The Premises include [Address] and any associated common areas.

The common areas of the Premises are shared equally by all roommates. These areas include but are not limited to [City] and any common seating areas. The roommates agree to maintain cleanliness in shared areas and collaboratively cover the costs associated with their use and maintenance.

Each roommate is entitled to have a separate private area of the Premises. Private areas include: For the Roommate 1: [State] ([Private area]). For the Roommate 2: [ZIP Code] ([Private area]). All Roommates must respect the boundaries and access rights to these private areas, and no Roommate shall enter another Roommate's personal space except in emergencies or with the roommate's permission.

PAYMENT TERMS AND PROCEDURE. The Parties have agreed to pay the rent on a [Payment Option Choose] basis. Each roommate is responsible for paying their share of the monthly rent by [Payment Method], calculated based on the total rent specified in the Lease Agreement. The total rent amount is [Rent amount]. The portion of the Roommate 1 is [Date of signing] ([Rent Amount Roommate1]). The portion of the Roommate 2 is [Are Details Agreement Under] ([Rent Amount Roommate2]). According to the Lease Agreement, the rent amount is [Beginning Date] and may be changed by written agreement between the Parties. The payment shall be made to the [End Date] Roommate 1 by the [Name] of each month. Each roommate shall make the payment by cash.

SECURITY PAYMENT. The roommates agree to require a security deposit of [Security deposit amount] payable before or at the time of move-in from each roommate to ensure compliance with the terms of this Agreement and to cover any damages beyond normal wear and tear. The security deposit shall be returned to the roommates within [City] days following the expiration or termination of this Agreement, based on the portion of each Party made to the total amount of a security deposit, subject to deductions for any unpaid rent, damages, or other agreed-upon expenses under this Agreement.

ROOMMATES' PROPERTY. The roommates acknowledge that specific items within the Premises are considered the common property intended for shared use among all Parties. These items of the common property include the following:

The roommates agree to jointly maintain and take good care of the common property, ensuring its proper use and maintenance.

The roommates are responsible for their personal property within the designated private areas, including belongings, furniture, and other personal items. Each roommate is responsible for maintenance, repair, and replacement of their personal property, and they shall not hold other Roommates liable for any damage or loss unless resulting from intentional actions or gross negligence. The roommates agree not to use or take the personal belongings owned by others.

UTILITIES.[Should Utility Expenses Be] [Who Should Receive Utility] The roommates are collectively responsible for utility expenses that shall be divided into equal parts. The total amount of utility costs should be calculated according to metering devices. The roommates are required to pay their share of utility bills to the Roommate 1 on time by the agreed date(s).

The roommates should strive to conserve utilities and use them responsibly. This includes reducing waste, engaging in energy-saving practices, and immediately reporting utility-related problems to the responsible person or service provider.

HOUSEHOLD DUTIES. All the roommates must participate in maintaining the cleanliness and order of the Premises. Each roommate is responsible for the personal area, ensuring it is clean and tidy. The roommates should establish a cleaning schedule to distribute cleaning responsibilities in the common areas fairly. The cleaning schedule must outline the specific tasks, frequency, and distribution of responsibilities among the roommates for each task.

The roommates must jointly provide the necessary cleaning supplies, including but not limited to cleaning products, brooms, mops, and vacuum cleaners. All roommates shall share the cost of cleaning supplies equally unless otherwise agreed. If the roommates decide to hire professional cleaning services for the Premises, the associated costs shall be shared equally among all roommates or as otherwise agreed.

From time to time, but not less than [Frequency of deep cleaning], the roommates shall set aside a specific time to perform deep cleaning tasks that go beyond the regular maintenance cleaning. This may include cleaning windows, carpets, curtains, or other areas requiring more intensive cleaning.

NEW ROOMMATES. If any roommate wishes to introduce a new roommate to the Premises, they must obtain consent from all current roommates before allowing the new roommate to move in. The new roommate is obligated to become a party to this Agreement by signing a statement that shall be the Annex to this Agreement and comply with its terms and conditions. The current roommates may jointly agree on any adjustments to rent distribution, security deposits, or other appropriate terms and conditions.

GUESTS. The roommates may host guests on the Premises, including overnight stays, for a maximum period of [Number of nights] nights. The hosting roommate is responsible for the guest's behavior, ensuring adherence to the terms of this Agreement, and must inform all roommates about the guest's presence and intended duration. Approval from all roommates is necessary for the presence of overnight guests, and unanimous agreement is required for guests staying beyond the specified maximum period.

EVENTS. The roommates may host social events and parties on the Premises, but they must obtain permission from all other Roommates before hosting such events. The roommates hosting events are responsible for ensuring that all guests adhere to the rules of this Agreement and local laws. Excessive noise, disturbances, or activities that disturb the peace are not allowed.

PARKING. Parking arrangements for vehicles shall be as follows: [Parking rules]. All roommates shall comply with these parking rules and local regulations. Any disputes or specific parking arrangements shall be resolved by mutual agreement among the roommates.

ADDITIONAL TERMS. The roommates may agree to include other terms and conditions to this Agreement by mutual consent. Any additional terms must be clearly stated in writing, signed by all roommates, and annexed to this Agreement.

TERM OF THE AGREEMENT. This Roommate Agreement shall commence on [Rent amount](the "Commencement Date") and shall continue until [Rent amount](the "End Date").

This Agreement can be renewed monthly, with an initial term of one month, unless terminated by any roommate by giving written notice to the other roommate. The notice of termination shall follow the notice provisions outlined in the Termination clause.

TERMINATION. If the roommate wishes to terminate this Agreement before the End Date, a written notice to the other roommate must be provided at least [Who Should Receive Payments] days in advance. The notice must include the intended date of termination.

If any roommate terminates this Agreement, the remaining roommate may agree to adjust the rent and expense sharing accordingly. The terminating roommate is accountable for meeting payment obligations until the termination date specified in the notice.

Alternatively, the departing roommate may find a new roommate to assume the duties and obligations under this Agreement. The new roommate must be approved by other roommate, and upon approval, the obligations of the departing roommate shall be transferred to the new roommate.

NOTICE. Any notice, request, demand, or other communication required to be given under this Agreement shall be in writing. It shall be deemed duly given if delivered personally or sent by the following email:

Either Party may change the address for receipt of notices by giving written notice to the other Party per this section.

FORCE MAJEURE. Neither Party shall be liable for any failure to perform or delay in performing the obligations under this Agreement if such failure or delay is caused by events of force majeure, including but not limited to acts of God, war, terrorism, strikes, lockouts, labor disputes, pandemics, epidemics, governmental regulations, or any other similar causes beyond the reasonable control of the affected Party. In the case of force majeure, the affected Party shall immediately notify the other Party in writing and provide reasonable proof of the cause of the delay or inability to perform the obligations. The Party affected by force majeure shall endeavor to mitigate the consequences of such circumstances and resume the performance of obligations as soon as possible after the circumstances cease to exist. If the force majeure circumstances last more than [Payment day] days, either Party may terminate this Agreement by giving written notice to the other Party. In this case, neither Party shall be liable to the other Party for any damages arising from the termination of this Agreement.

SEVERABILITY. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Agreement.

WAIVER. The failure of any Party to enforce a particular provision of this Agreement shall not constitute a waiver of their right to enforce that provision in the future.

ENTIRE AGREEMENT. This Agreement constitutes the entire understanding between the Parties and supersedes all prior or contemporaneous agreements, understandings, negotiations, or discussions, whether oral or written, relating to the subject matter of this Agreement.

ANNEXES. Any annexes, appendices, schedules, and exhibits to this Agreement are considered its integral parts. In case of any inconsistencies between the provisions of the main body of this Agreement and its Annexes, the provisions of the main body of this Agreement shall prevail.

What Is a Lease Agreement Roommate?

A Lease Agreement Roommate in the United States governs the letting of property, fixing the rent, duration and the duties of landlord and tenant.

The legal enforceability of roommate agreements depends on state contract law principles. Because roommate agreements satisfy the essential elements of a contract — offer, acceptance, consideration, and mutual assent — they are generally enforceable in court as private agreements. However, any provision that conflicts with the master lease or state landlord-tenant law is unenforceable. For example, a roommate agreement cannot override the landlord's rights under the primary lease or waive protections guaranteed by statute.

Joint and several liability is a critical concept in roommate arrangements. When multiple tenants sign a lease, most leases impose joint and several liability, meaning the landlord can pursue any individual tenant for the full amount of unpaid rent or damages under the Restatement (Second) of Contracts. The roommate agreement creates a separate right of contribution among the co-tenants, allowing a roommate who pays more than their agreed share to seek reimbursement from the others.

When Do You Need a Lease Agreement Roommate?

College students and young professionals moving into a shared apartment need a roommate agreement before the first month's rent is due. Disputes over utility payments, cleaning responsibilities, and guest policies are the leading causes of roommate conflicts, and a written agreement establishes expectations before habits form and resentments develop.

Existing roommate arrangements that have been operating informally need a written agreement when a new roommate joins or when a recurring dispute reveals the absence of clear rules. Adding a new roommate mid-lease often requires landlord approval and an amendment to the master lease, and the roommate agreement should be executed simultaneously with the lease modification.

Co-tenants with significantly different financial contributions — such as when one roommate occupies the master bedroom and another takes a smaller room — need an agreement that documents the negotiated rent split. Without written terms, a departing roommate may dispute the allocation and seek reimbursement for alleged overpayments.

Roommates who bring personal property of significant value, such as electronics, furniture, or artwork, into shared spaces benefit from an agreement that documents ownership and establishes liability for damage. The agreement prevents disputes about who owns shared household items purchased during the cohabitation and defines the process for dividing or replacing jointly purchased property when the arrangement ends.

What to Include in Your Lease Agreement Roommate

The financial allocation section must specify each roommate's share of rent, how the total rent payment is collected and submitted to the landlord, and the deadline for each roommate's contribution. If one roommate collects all payments and submits a single check, the agreement should designate this responsibility and establish consequences for late individual contributions.

Utility cost-sharing provisions should detail which utilities are shared (electricity, gas, water, internet, streaming services), the division formula (equal split, usage-based, or proportional to room size), and who holds each account. The agreement should specify the payment deadline relative to the billing cycle and the procedure if one roommate consistently underpays or overpays.

Common area usage rules must address cleaning schedules and standards, kitchen storage allocation, refrigerator shelf assignments, bathroom schedules in single-bathroom units, and shared living space etiquette. These provisions should be specific enough to resolve disputes without being so rigid that they become impractical.

Guest and overnight visitor policies should define notice requirements, frequency limits, and duration caps for overnight guests. Extended guest stays can create unauthorized occupancy issues under the master lease and may violate local occupancy codes. The agreement should specify when a guest becomes a de facto roommate requiring a formal addition to the arrangement.

Termination and departure procedures must specify the notice period one roommate must provide before vacating, responsibility for finding a replacement, the departing roommate's obligations for their share of remaining lease obligations, and the process for returning security deposit shares. The agreement should address the practical question of whether the remaining roommates have approval rights over replacement candidates, subject to Fair Housing Act restrictions on discriminatory selection criteria.
