6. EXCHANGES

Under UCC Section 2-608, buyers have the right to revoke acceptance of non-conforming goods within a reasonable time, and a return policy defines what constitutes reasonable. State consumer protection statutes add additional layers — California Civil Code Section 1723 requires retailers to clearly display their return policy and imposes a full refund right for items returned within 30 days if no policy is posted.

For e-commerce businesses, the return policy intersects with additional regulatory frameworks including the FTC's Cooling-Off Rule (16 CFR Part 429) for door-to-door sales exceeding $25, state-specific online shopping protections, and credit card chargeback regulations under the Fair Credit Billing Act (15 U.S.C. When Do You Need a Return Policy Template?

Define the refund method precisely — whether customers receive a refund to the original payment method, store credit, or exchange. Under the Truth in Lending Act and Regulation Z, credit card refunds must be processed to the original card within a reasonable timeframe, and many state laws specify maximum processing periods. Include the process for initiating returns, such as requiring a return merchandise authorization (RMA) number, prepaid shipping labels, or in-store return procedures. Address who bears the cost of return shipping and any applicable restocking fees, which are prohibited or restricted in several states.

For e-commerce businesses, include provisions addressing international returns, shipping damage claims, and the distinction between buyer's remorse returns and returns for defective or non-conforming goods under UCC Section 2-714. Reference your warranty terms separately to avoid conflating return rights with warranty coverage under the Magnuson-Moss Warranty Act (15 U.S.C. Sections 2301-2312).
