VENUE HIRE AGREEMENT

This Venue Hire Agreement (the "Agreement") is entered into on [Agreement Date] between:

1. VENUE

1.1 The Venue Owner agrees to hire to the Hirer the venue known as [Venue Name], situated at [Venue Address], [Venue City], [Venue Postcode] (the "Venue") for the purposes set out in this Agreement.

1.2 The maximum permitted capacity of the Venue is [Venue Capacity] persons. The Hirer must not at any time permit the number of persons at the Venue to exceed this limit.

2. EVENT DETAILS

2.1 The Venue is hired for the following event: [Event Type] (the "Event").

2.2 The Event date is [Event Date].

2.3 The Hirer shall have access to the Venue from [Access Start Time] for the purposes of setting up and preparing for the Event.

2.4 The Event shall commence at [Event Start Time] and the Hirer shall vacate the Venue and return it to its original condition no later than [Event End Time].

2.5 The expected number of guests attending the Event is [Expected Guests], which the Hirer warrants will not exceed the Venue's maximum permitted capacity of [Venue Capacity] persons.

3. HIRE FEE AND PAYMENT

3.1 The total hire fee for the Venue is £[Hire Fee] (the "Hire Fee").

3.2 A booking deposit of £[Deposit Amount] is payable by [Deposit Due Date] to confirm the booking. Time is of the essence in respect of this payment.

3.3 The balance of the Hire Fee is payable in full by [Balance Due Date].

3.4 All payments shall be made by [Payment Method].

3.5 All amounts stated in this Agreement are inclusive of VAT (if applicable) unless otherwise stated.

4. CATERING AND ALCOHOL

4.1 Catering for the Event shall be: [Catering Arrangement].

5. CANCELLATION

5.1 If the Hirer cancels the booking, the Hirer must notify the Venue Owner in writing as soon as possible.

5.2 If the Hirer cancels with [Cancellation Terms], the balance of the Hire Fee (excluding the booking deposit) will be refunded. If the Hirer cancels with less than the stipulated notice, no refund of the balance shall be due.

5.3 The booking deposit is [Deposit Refundable] on cancellation.

5.4 If the Venue Owner cancels the booking, any payments made by the Hirer (including the deposit) shall be refunded in full within 14 days. The Venue Owner's liability for cancellation shall be limited to the amount of the Hire Fee paid.

6. HIRER'S OBLIGATIONS

6.1 The Hirer shall:

  • use the Venue only for the Event described in this Agreement and for no other purpose
  • ensure all guests comply with the Venue's rules and conditions
  • not permit the number of persons at the Venue to exceed the maximum permitted capacity of [Venue Capacity]
  • not cause or permit any nuisance, disturbance, or annoyance to neighbouring properties
  • return the Venue to its original condition by [Event End Time], removing all equipment, decorations, and waste
  • pay for any damage caused to the Venue, its fixtures, fittings, or equipment during the hire period
  • comply with all applicable health and safety legislation, including the Health and Safety at Work etc. Act 1974

6.2 The Hirer must hold public liability insurance with a minimum cover of £[Public Liability Minimum] and must provide evidence of such insurance to the Venue Owner upon request.

7. LIABILITY AND INDEMNITY

7.1 The Venue Owner shall take reasonable care to ensure that the Venue is safe for use by visitors in accordance with the Occupiers' Liability Act 1957. The Venue Owner does not exclude liability for death or personal injury caused by its negligence.

7.2 The Venue Owner shall not be liable for any loss, damage, or injury suffered by the Hirer or any guest arising from: (a) the Hirer's failure to comply with the Venue's rules; (b) the actions of guests at the Event; (c) any cause beyond the Venue Owner's reasonable control.

7.3 The Hirer shall indemnify and keep indemnified the Venue Owner against all claims, losses, damages, costs, and expenses arising from the Hirer's use of the Venue or the conduct of the Event, save to the extent caused by the Venue Owner's negligence or breach of duty.

7.4 Nothing in this Agreement shall limit or exclude liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded by law.

8. GENERAL

8.1 This Agreement constitutes the entire agreement between the parties in respect of the hire of the Venue and supersedes any prior discussions, representations, or arrangements.

8.2 No variation of this Agreement shall be effective unless agreed in writing and signed by both parties.

8.3 This Agreement shall be governed by and construed in accordance with the law of England and Wales. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8.4 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
