What Is a TESDA Scholarship Agreement (Philippines)?

A TESDA Scholarship Agreement in the Philippines sets out the mutual obligations the parties accept and the terms that govern their dealings.

TESDA, established by RA 7796 under the Department of Labor and Employment (DOLE), administers the national Technical-Vocational-Livelihood (TVL) education and training system and the Philippine TVET Qualifications Framework (PTQF). The TESDA scholarship programs provide full or partial funding for qualified beneficiaries to enroll in TESDA-registered TVL programs that lead to a National Certificate (NC I, NC II, NC III, or NC IV) or a Certificate of Competency (COC) upon passing the TESDA National Assessment.

The TESDA TWSP scholarship covers tuition fees, training materials, and assessment fees for programs aligned with TESDA-identified priority sectors: agriculture and fisheries, construction, electronics, health and social services, ICT and BPO, maritime, tourism and hospitality, automotive and land transport, and electrical installation and maintenance. TESDA releases TWSP program guidelines and approved course list through TESDA Circular No. 35 (2013, as updated) and annual TWSP procurement guidelines under RA 9184 (Government Procurement Reform Act).

For enterprise-based TESDA programs under the Dual Training System (Republic Act No. 7686, Dual Training System Act of 1994), the TESDA Scholarship Agreement governs the scholar's in-plant training with an enterprise partner, outlining the training duration, modules, workplace assessor responsibilities, and National Assessment schedule.

The legal framework governing the TESDA Scholarship Agreement (Philippines) in Philippines draws on several key statutes and regulatory bodies. Under Philippine law, the Civil Code of the Philippines (Republic Act No. 386) governs contractual obligations. The Revised Corporation Code (Republic Act No. 11232) regulates corporate entities through the Securities and Exchange Commission (SEC). The Labor Code of the Philippines (Presidential Decree No. 442) and Department of Labor and Employment (DOLE) govern employment matters. The Data Privacy Act of 2012 (Republic Act No. 10173) and the National Privacy Commission (NPC) protect personal data. The Bureau of Internal Revenue (BIR) administers tax obligations under the National Internal Revenue Code. Parties executing a TESDA Scholarship Agreement (Philippines) in Philippines should confirm the document reflects current law, including any amendments enacted since the original drafting date. The Labor Code of the Philippines (PD 442) sets the foundational requirements.

When Do You Need a TESDA Scholarship Agreement (Philippines)?

A TESDA Scholarship Agreement in the Philippines is needed when a scholar and a TESDA-accredited training institution or enterprise formalize the terms of a TESDA-funded training program.

A TESDA Scholarship Agreement is required when a TWSP scholarship recipient enrolls at a TESDA-accredited TTI under a TWSP-approved course. The agreement governs the scholar's obligations — attendance, completion of modules, National Assessment — and the TTI's obligations — quality training delivery, assessment facilitation, and scholarship fund liquidation to TESDA under RA 9184.

A TESDA Scholarship Agreement is needed when an enterprise participating in TESDA's Enterprise-Based Training Program under the Dual Training System (RA 7686) accepts trainees from a partner TESDA school. The agreement specifies the training modules to be delivered at the enterprise, the hours of enterprise-based training vs. school-based training, the roles of the enterprise trainer/assessor, and the trainees' compensation (if any) during enterprise training.

A TESDA Scholarship Agreement is required when a TESDA NC II or NC III scholar agrees to a post-training employment commitment with an employer who funded or co-funded the TESDA scholarship through the DOLE-TESDA Industry Partnership or the TESDA Special Scholarship for Priority Sectors. The employment commitment — typically 1–2 years post-certification — must be stipulated in the scholarship agreement.

A TESDA Scholarship Agreement is needed when a person benefits from the TESDA STEP (Special Training for Employment Program) under DOLE Kabuhayan para sa Bagong Pilipino (KaBaPil) and similar DOLE-TESDA livelihood programs for indigent, displaced, or marginalized workers, which require a formal scholarship agreement before training begins.

Parties in Philippines should prepare a TESDA Scholarship Agreement (Philippines) proactively rather than waiting for a dispute to arise. Courts interpret agreements based on the written terms rather than oral representations. Where the transaction involves regulated activities, prior approval from the relevant authority may be required before execution.

What to Include in Your TESDA Scholarship Agreement (Philippines)

A valid TESDA Scholarship Agreement in the Philippines must include the following elements to comply with TESDA scholarship program requirements and RA 7796.

Parties and Scholarship Program: Full legal names of the scholar (with PhilSys ID or government ID number) and the TESDA-accredited training institution or enterprise (with TESDA Accreditation Number). The specific TESDA scholarship program — TWSP, STEP, PESFA, or enterprise-based program — must be identified, with the TESDA approval or authority document reference.

Course and Qualification Level: The specific TESDA-registered TVL course title, TESDA Training Regulation (TR) code, and TVET Qualifications Framework (PTQF) level — NC I, NC II, NC III, NC IV, or COC — that the scholar will pursue. The training duration in hours (as prescribed by the TESDA TR) and the training schedule must be specified.

Scholarship Coverage: The specific benefits covered by the TESDA scholarship — tuition fees (full or partial), assessment fees for TESDA National Assessment, training materials and tools allowance, and living/transportation allowance (if applicable). TWSP scholarship amounts are set by TESDA per cost of training guidelines and vary by program and region.

Scholar Obligations: The scholar's attendance requirements (minimum 80% attendance for TESDA programs), conduct standards, obligation to take the TESDA National Assessment upon program completion, and any post-training employment commitment to an enterprise that funded or co-funded the scholarship.

National Assessment and Certification: The schedule and venue for the TESDA National Assessment (competency assessment) by a TESDA-accredited assessor or Assessment Center. Upon passing, the scholar receives a National Certificate (NC) or Certificate of Competency (COC) from TESDA. Failure to take or pass the National Assessment may affect the scholar's obligation to repay training costs per TESDA program guidelines.

Grounds for Scholarship Termination: Conduct that results in scholarship withdrawal — excessive absences (below 80% attendance), violation of training center rules, academic dishonesty, or voluntary withdrawal from the program. Scholarship repayment conditions if the scholar withdraws without valid cause must be stated.

Additional compliance elements for a TESDA Scholarship Agreement (Philippines) used in Philippines include: Under Philippine law, the Civil Code of the Philippines (Republic Act No. 386) governs contractual obligations.
