What Is a Guardianship Application (Hong Kong)?

A Guardianship Application in Hong Kong is a formal legal document used to apply for the appointment of a guardian for a minor child (a person under 18 years of age) under the Guardianship of Minors Ordinance (Cap. 13), submitted to the Family Court or the Court of First Instance of the High Court of Hong Kong.

The Guardianship of Minors Ordinance (Cap. 13) is the primary legislation governing guardianship of children in Hong Kong. Section 3 of Cap. 13 establishes the paramount principle: in all proceedings before the court relating to the custody or upbringing of a minor, the welfare of the minor is the first and paramount consideration. No other factor — including the preferences of the applicant, financial circumstances, or cultural traditions — can override the court’s duty to promote the child’s welfare.

Guardianship under Cap. 13 confers on the appointed guardian the legal responsibility to care for the minor’s person — making decisions about day-to-day upbringing, education, medical treatment, religion, and general welfare — and, where authorised by the court, to manage the minor’s property and financial affairs. A guardian under Cap. 13 does not automatically become the child’s legal parent for all purposes (for example, the child does not acquire inheritance rights from the guardian under the Intestates’ Estates Ordinance Cap. 73 unless formally adopted), but has full parental responsibility for day-to-day decision-making.

Section 6 of Cap. 13 permits a parent to appoint a testamentary guardian by will under the Wills Ordinance (Cap. 30) — a person who will act as the child’s guardian upon the parent’s death. A testamentary guardian appointed by will may need to obtain court confirmation if the appointment is contested or if there is a surviving parent with parental rights. The Probate Registry of the High Court handles the estate of the deceased parent, while the Family Court handles guardianship disputes.

Guardianship proceedings in Hong Kong are also affected by the Adoption Ordinance (Cap. 290), which provides an alternative legal mechanism where the applicant seeks to become the child’s legal parent rather than merely their guardian, and the Child Abduction and Custody Ordinance (Cap. 512), which implements the Hague Convention on the Civil Aspects of International Child Abduction and governs cross-border custody and guardianship disputes involving children brought into or removed from Hong Kong.

The Social Welfare Department of the Hong Kong SAR Government is central in guardianship proceedings. The court frequently directs the Social Welfare Department to prepare a welfare report (also called a social investigation report) assessing the child’s circumstances, the applicant’s suitability as guardian, and the arrangements proposed for the child’s care. When Do You Need a Guardianship Application (Hong Kong)?

A Guardianship Application in Hong Kong is needed in any of the following circumstances where a responsible adult seeks formal court authority to act as the legal guardian of a child under the Guardianship of Minors Ordinance (Cap. 13).

A grandparent, aunt, uncle, or other relative who has been caring for a child whose parents have both died needs to file a Guardianship Application with the Family Court to obtain formal legal authority to make decisions about the child’s education, medical treatment, and immigration status. Without a formal appointment, schools, hospitals, and immigration authorities may not recognise the carer’s authority to act on the child’s behalf.

A family friend or close associate named as the intended guardian in the will of a deceased parent under Section 6 of Cap. 13 — whose testamentary appointment is disputed by the surviving parent or another relative — needs to apply to the Family Court for a formal guardianship order to establish their legal authority over the child.

A Hong Kong resident who has been raising a relative’s child from another jurisdiction — including Mainland China, Southeast Asia, or elsewhere — needs a Guardianship Application to regularise the child’s status in Hong Kong for purposes of school enrolment under the Education Ordinance (Cap. 279), medical care under the Hospital Authority, and Dependent Visa applications to the Immigration Department.

A parent who is seriously ill with a long-term or terminal condition and wishes to confirm their child will be cared for by a specified person if the parent becomes incapacitated or dies should file a Guardianship Application to formalise the proposed guardian’s appointment, in conjunction with preparing a will naming the same person as testamentary guardian under Cap. 30.

A professional carer, social worker, or residential care home operator who has been placed in charge of a child by the Social Welfare Department following the removal of the child from their family due to abuse, neglect, or abandonment needs a formal Guardianship Application to obtain legal authority for major decisions not covered by the Social Welfare Department’s administrative placement.

A non-biological parent — including a same-sex partner of the child’s biological parent, a step-parent, or a long-term de facto partner — who has been living with and caring for a child may apply for guardianship under Cap. 13 to obtain legal recognition of their parental role, although adoption under the Adoption Ordinance (Cap. 290) provides a more permanent status.

An executor or administrator of a deceased parent’s estate under the Probate and Administration Ordinance (Cap. 10) who needs to manage assets held for the benefit of a minor child needs a Guardianship Application to obtain authority over the child’s personal welfare in addition to the property management authority conferred by the grant of probate or letters of administration.

A sponsor or guardian for a student under 18 who is attending school in Hong Kong on a student visa needs documentation of their legal guardianship status to satisfy the requirements of the Immigration Department and the school’s safeguarding policy under the Education Bureau guidelines.

What to Include in Your Guardianship Application (Hong Kong)

A Guardianship Application in Hong Kong under the Guardianship of Minors Ordinance (Cap. 13) requires the following key elements to meet the requirements of the Family Court and the Social Welfare Department.

Applicant identification provides the full legal name, Hong Kong Identity Card number or passport number, residential address, occupation, and contact details of the person applying to be appointed as guardian. The applicant’s relationship to the child must be clearly stated — grandparent, aunt/uncle, family friend, neighbour, or other — together with the length and nature of their existing relationship with the child.

Child’s details set out the child’s full legal name, date of birth, Hong Kong Identity Card number or birth certificate number, current residential address, name and contact details of current school (registered with the Education Bureau), and a description of the child’s current living arrangements and daily care routine.

Parental status documents the current status of both parents: whether living or deceased (with certified death certificate from the Registration of Births and Deaths), whether incapacitated and in what respect (with supporting medical report from a registered medical practitioner under Cap. 161), whether voluntarily absenting themselves from the child’s life, or whether they have had their parental rights restricted or removed by a court order. Where a parent is alive and capable, their written consent to the guardianship application should be obtained and filed.

Reasons for the application explains in clear terms why guardianship is being sought — the circumstances that have led to the child’s parents being unable to exercise parental responsibility — and why the applicant is the appropriate person to be appointed as guardian.
