What Is a Hawker Licence Application (Hong Kong)?

A Hawker Licence Application in Hong Kong is a formal application submitted to the Food and Environmental Hygiene Department (FEHD) under the Public Health and Municipal Services Ordinance (Cap. 132) and the Hawker Regulation (Cap. 132AI) to obtain a government licence authorising the applicant to operate as a street hawker at a designated pitch or itinerantly within permitted areas.

Hawking — the selling of goods or food from portable stalls, trolleys, or fixed pitches on streets and in public spaces — has been part of Hong Kong’s urban commercial culture for more than a century. The FEHD administers hawker licensing as part of its mandate to maintain public hygiene, manage street cleanliness, and regulate street-level commerce under the Public Health and Municipal Services Ordinance (Cap. 132). The Hawker Regulation (Cap. 132AI) sets out the specific licensing categories, conditions, fees, and enforcement mechanisms that govern Hong Kong’s hawker trade.

Operating as a hawker without a valid licence from the FEHD is a criminal offence under Section 83 of Cap. 132. Unlicensed hawking is actively enforced by FEHD Hawker Control Teams, who conduct regular patrols in commercial districts, tourist areas, and night markets. Offenders are liable to prosecution, fines, and confiscation of goods. The FEHD issues fixed penalty notices for hawking offences under the Fixed Penalty (Public Cleanliness Offences) Ordinance (Cap. 570) in addition to pursuing criminal prosecution in appropriate cases before the Magistrates’ Courts.

The three main categories of FEHD hawker licences are Fixed Pitch Hawker Licences (authorising operation from a permanently designated pitch in a recognised hawker area, cooked food market, or market bazaar), Itinerant Hawker Licences (authorising mobile vending within specified streets or districts), and Cooked Food Hawker Licences (authorising the preparation and sale of cooked food from a designated pitch, subject to additional food safety requirements under the Food Business Regulation Cap. 132X).

The FEHD has maintained a general moratorium on issuing new hawker licences in most categories since the 1970s, citing concerns about pedestrian congestion, hygiene management, and urban planning. The waiting list for fixed pitch licences in popular hawker areas — including Temple Street Night Market in Jordan, Tung Choi Street (Ladies’ Market) in Mong Kok, and the Flower Market in Prince Edward — can be extensive. Existing licences command significant informal commercial value despite the strict transfer restrictions under Cap. 132AI.

For prospective hawkers unable to obtain a standard licence, the FEHD and district administrations occasionally issue temporary licences for government-approved bazaars, night fairs, and festive markets — such as the annual Chinese New Year Fair (年宵市場) administered by the Leisure and Cultural Services Department (LCSD). These temporary approvals provide a legal pathway for short-term street vending without the need for a permanent hawker licence.

The Lands Department and the Buildings Department may also be relevant where a hawker pitch occupies government land or where the pitch involves any structure attached to the ground, as separate approvals under the Land (Miscellaneous Provisions) Ordinance (Cap. 28) and the Buildings Ordinance (Cap. 123) may be required. The Business Registration Office of the Inland Revenue Department (IRD) requires all hawkers conducting a business to maintain a valid Business Registration Certificate under the Business Registration Ordinance (Cap. 310).

Related documents include the Food Licence Application (for fixed-premises food businesses), the Business Registration Renewal (for ongoing compliance with Cap. 310), the Statutory Declaration (required for certain FEHD applications), and the Trademark Application (for hawkers developing a recognisable brand). Forms-legal.com provides templates for these government and regulatory application documents to assist Hong Kong small business operators in navigating the licensing framework.

When Do You Need a Hawker Licence Application (Hong Kong)?

A Hawker Licence Application in Hong Kong is needed in any of the following circumstances where a person wishes to engage in street vending or mobile commerce under the regulatory framework of the Food and Environmental Hygiene Department (FEHD) and the Public Health and Municipal Services Ordinance (Cap. 132).

An individual who wishes to sell goods — clothing, accessories, household items, snacks, or fresh produce — from a fixed pitch in one of Hong Kong’s recognised hawker areas or public markets needs to apply to the FEHD for a Fixed Pitch Hawker Licence before commencing operations. Operating without a licence exposes the person to criminal prosecution under Section 83 of Cap. 132 and confiscation of stock by FEHD Hawker Control Teams.

A person who wishes to operate a cooked food stall — selling traditional Hong Kong street food such as fish balls, egg waffles, stinky tofu, or roasted chestnuts — from a designated cooked food pitch in a recognised cooked food market needs both a Cooked Food Hawker Licence from the FEHD and compliance with the food safety requirements under the Food Business Regulation (Cap. 132X) and the Centre for Food Safety guidelines.

A hawker who holds a valid Fixed Pitch or Itinerant Hawker Licence that is due for annual renewal must submit a renewal application to the FEHD Hawker Licensing Section before the licence expiry date, together with the applicable renewal fee. Allowing the licence to lapse requires a fresh application and may result in loss of pitch allocation.

A family member of a deceased or permanently incapacitated licensed hawker who wishes to continue operating the pitch must apply to the FEHD for a transfer of the licence. The transfer application must be filed promptly after the licence holder’s death or incapacitation to preserve the right to continue operating. The FEHD has discretion to permit transfers to immediate family members who meet the eligibility requirements under Cap. 132AI.

A charity, community organisation, or school wishing to operate a temporary stall at a government-approved bazaar, fair, or festive market — such as a school fair, community bazaar, or charity sale — needs to obtain the appropriate FEHD approval or temporary licence before setting up the stall. Permanent hawker licences are not transferable to these temporary vending arrangements.

A hawker who has been issued with an improvement notice or enforcement notice by the FEHD Hawker Control Team regarding hygiene, pitch conditions, or licence compliance needs to address the specified deficiencies and, if the notice relates to a suspended licence, must submit a reinstatement application to the FEHD with evidence that the issues have been rectified.

An existing hawker who wishes to change the nature of goods sold, expand the pitch boundaries, or alter the operating hours specified in their licence must apply to the FEHD for a licence variation before implementing any changes. Unauthorised changes to licence conditions may result in suspension or revocation of the licence.

A person who has received a rejection of a previous hawker licence application and has addressed the identified deficiencies — for example, by obtaining the required Food Handler’s Certificate, providing missing documentation, or clarifying their eligibility — should submit a fresh application to the FEHD Hawker Licensing Section.

What to Include in Your Hawker Licence Application (Hong Kong)

A Hawker Licence Application in Hong Kong submitted to the Food and Environmental Hygiene Department (FEHD) under the Public Health and Municipal Services Ordinance (Cap. 132) and the Hawker Regulation (Cap. 132AI) must contain the following key elements to constitute a complete and properly prepared submission.

Applicant identification provides the full legal name, Hong Kong Permanent Identity Card number (HKID), date of birth, residential address, and contact telephone number and email address of the applicant. The applicant must be a Hong Kong permanent resident and an individual (not a company or organisation). A copy of the applicant’s HKID card must be attached.

Business Registration Certificate confirmation provides evidence that the applicant has obtained or applied for a Business Registration Certificate from the Business Registration Office of the Inland Revenue Department (IRD) under the Business Registration Ordinance (Cap. 310). All hawkers conducting a business in Hong Kong must maintain a valid Business Registration Certificate.

Licence category specification identifies the category of hawker licence being applied for: Fixed Pitch Hawker Licence (specifying the desired location and pitch); Itinerant Hawker Licence (specifying the area or route); or Cooked Food Hawker Licence (specifying the pitch and the type of food to be sold). The application must specify the intended goods or food to be sold.

Proposed pitch location (for fixed pitch applications) identifies the specific location of the desired pitch — the street address, district, recognised hawker area name, and any existing pitch number — together with the applicant’s basis for requesting that specific pitch (waiting list position, family succession, or other qualifying basis).

Food Handler’s Certificate (for Cooked Food Hawker Licences) provides a copy of the applicant’s valid Food Handler’s Certificate issued by the FEHD or other approved body, demonstrating completion of the required food hygiene training and examination under the Centre for Food Safety requirements.

Supporting declarations and statutory declarations confirm the applicant’s eligibility, the accuracy of the information provided, and compliance with the licensing conditions. Certain FEHD application forms require a statutory declaration sworn before a solicitor or Commissioner for Oaths under the Oaths and Declarations Ordinance (Cap. 11).

Application fee payment confirms that the prescribed application fee has been paid to the FEHD. The current fee schedule is available from the FEHD Hawker Licensing Section and is subject to periodic revision. Payment is typically by cashier’s order or bank draft payable to the Hong Kong SAR Government.

Contact details and acknowledgment provides the applicant’s preferred address for correspondence from the FEHD and acknowledges the applicant’s agreement to comply with all conditions of the licence if granted, including maintenance of pitch hygiene, compliance with operating hours, and the prohibition on unauthorised transfer or subletting.

Appeal rights acknowledgment notes the applicant’s right to appeal a rejection to the Administrative Appeals Board (AAB) under the Administrative Appeals Board Ordinance (Cap. 442) within 14 days of the FEHD’s decision, as provided under Section 5 of Cap. 442. Applicants should note that Section 83 of the Public Health and Municipal Services Ordinance (Cap. 132) creates the offence of unlicensed hawking, and Section 86 of Cap. 132 empowers FEHD officers to seize goods from unlicensed hawkers. Forms-legal.com provides this Hawker Licence Application template as a starting framework — applicants should contact the FEHD Hawker Licensing Section directly to obtain the current official application forms and the most up-to-date requirements for their desired licence category. Reinstatement and variation requests address the process by which a hawker whose licence has been suspended by the FEHD for hygiene or compliance violations can apply for reinstatement. The application must demonstrate that all identified deficiencies have been remedied and may require an inspection by FEHD officers before the licence is reinstated. Any proposed change to goods sold, operating hours, or pitch boundaries requires a separate variation application to the FEHD under Cap. 132AI, with submission of the relevant supporting documentation and payment of any applicable variation fee to the FEHD.

How to Fill Out Your Hawker Licence Application (Hong Kong)

Completing a Hawker Licence Application in Hong Kong requires careful preparation across several stages before submission to the Food and Environmental Hygiene Department (FEHD) Hawker Licensing Section.

Step 1 — Obtain the official application form. Contact the FEHD Hawker Licensing Section directly to obtain the current prescribed application form for the licence category sought (Fixed Pitch, Itinerant, or Cooked Food). Forms change periodically and the version available from the FEHD is the only accepted format. The Section is located at the FEHD Headquarters, 41 Mui Wo Ferry Pier Road, Lantau Island (District offices also handle enquiries).

Step 2 — Confirm eligibility before completing the form. Verify that the applicant is a Hong Kong permanent resident holding a valid Hong Kong Permanent Identity Card, is at least 18 years of age, and holds no disqualifying convictions under the Public Health and Municipal Services Ordinance (Cap. 132). For Cooked Food Hawker Licences, obtain a valid Food Handler's Certificate from the Centre for Food Safety or the FEHD before proceeding.

Step 3 — Complete the applicant particulars section. Enter the full legal name exactly as it appears on the HKID card, the HKID number, date of birth, residential address, and contact details. Attach a clear photocopy of both sides of the HKID card.

Step 4 — Specify the licence category and pitch details. Identify the licence category and, for Fixed Pitch applications, state the precise location of the desired pitch including the district, recognised hawker area name, street address, and any existing pitch number. Provide the basis of the application — waiting list position, family succession, or other qualifying ground under the Hawker Regulation (Cap. 132AI).

Step 5 — Attach the Business Registration Certificate. All hawkers conducting a business must hold a valid Business Registration Certificate under the Business Registration Ordinance (Cap. 310). Attach a copy of the current Certificate or evidence that an application has been made to the Business Registration Office of the Inland Revenue Department.

Step 6 — Complete the statutory declaration if required. Certain FEHD application forms require a statutory declaration sworn before a Commissioner for Oaths or solicitor under the Oaths and Declarations Ordinance (Cap. 11). Have the declaration witnessed at this stage — do not sign in advance.

Step 7 — Calculate and pay the application fee. The prescribed application fee is set out in the FEHD's current fee schedule under Cap. 132AI and is subject to periodic revision. Payment to the Hong Kong SAR Government is typically by cashier's order or bank draft — confirm the accepted payment method with the Hawker Licensing Section before submission. Retain the payment receipt.

Step 8 — Submit the complete application package. Lodge the completed form, all attachments, the statutory declaration, and the fee payment at the FEHD Hawker Licensing Section. Request a dated acknowledgement of receipt. The FEHD conducts a background check and may inspect the proposed pitch before reaching a decision.

Deadlines and penalties. No specific annual renewal deadline is universal — the licence renewal date is stated on the face of the licence. Allow at least four to six weeks for processing a new application. Allowing a licence to lapse requires a fresh application and may result in loss of pitch allocation. Operating without a valid licence is a criminal offence under Section 83 of Cap. 132, carrying fines and imprisonment on conviction before the Magistrates' Courts.

Record retention. Keep copies of the completed application, all attachments, the payment receipt, and the issued licence for the duration of the licence period and for at least two years thereafter. The FEHD may request documentation during inspections.
