How the table was checked
Each row was compiled from the official source linked next to it (legislation, regulations or the registry’s own fee schedule) and then checked a second time, row by row, against the same source. Government fees only: agent, lawyer and notary fees are not included. Fees change, so open the official source before you file.
- Left out on purpose: attorney fees; WIPO fees for outgoing Madrid applications (see next point); Madrid transmittal/certification and notice-of-replacement fees under 37 CFR 7.6(a)(1)-(5); TTAB appeal-extension and oral-hearing fees; service fees (certified copies, document copies) under 37 CFR 2.6(b). These are official fees that can be read from the same sources.
- The surcharges in 37 CFR 2.6(a)(1)(iv)-(vi) apply to Section 1 and Section 44 applications under the conditions in 37 CFR 2.22(b)-(d); the `conditions_notes` column states each trigger.
- The table shows government fees only. It does not include attorney fees or WIPO international fees for outgoing Madrid applications (37 CFR 7.7), because those depend on the WIPO fee calculator and exchange rates.
- The combined-filing rows (Section 8 + 9, Section 8 + 15) add up separate fees as the USPTO fee schedule lists them. They are not separate fees.
- The USPTO can change fees by rulemaking. Check the sources above before filing.
