Stamp duty on leases and tenancy agreements

Stamp duty on a lease of land or buildings, checked against the statute or tax authority on 31 October 2026. Kenya charges about 1% of the annual rent for a lease of one to three years and about 2% for a longer or indefinite term (Stamp Duty Act, Cap. 480, Schedule item 21). Malaysia charges RM1, RM3, RM5 or RM7 per RM250 of annual rent for terms up to 1, 3, 5 or more years, on the full rent since 1 January 2025, with a RM10 minimum per instrument. Singapore charges 0.4% of the total rent for a lease of up to four years and 0.4% of four times the average annual rent for a longer one; a lease at S$1,000 a year or less is exempt. None of the three laws charges residential and commercial leases differently.

Kenya

Lease or licence for a definite term not exceeding one year: whole amount payable up to KES 2,000

Payable by the lessee or licensee. Residential and commercial leases pay the same rate; the Act draws no county or urban/rural distinction for rent. An agreement for a lease is charged as if it were the lease (s.55(1)).

Lease or licence for a definite term not exceeding one year: amount payable above KES 2,000

Added to the KES 20 for the first KES 2,000. Charged on the whole amount payable for the term, not on an annualised rent. Payable by the lessee.

KES 10 per KES 1,000 or part of the excess over KES 2,000 of the whole amount payable (about 1%)Stamp Duty Act (Cap. 480) s.56 and Schedule item 21(1)kenyalaw.org Checked 31 October 2026
Lease or licence for a definite term of one to three years: annual (or average annual) rent up to KES 2,000

The Act says 'not less than one year but not exceeding three years', and the band above says 'not exceeding one year', so a term of exactly one year fits both wordings. Payable by the lessee.

Lease or licence for a definite term of one to three years: annual (or average annual) rent above KES 2,000

Charged on one year's rent (rate or average rate), not on total rent for the term. Example: KES 50,000 a month (KES 600,000 a year) on a 2-year lease = 600 x KES 10 = KES 6,000. Payable by the lessee.

Lease or licence for any longer definite term (over three years) or indefinite term: annual rent up to KES 2,000

Payable by the lessee. There is no further band above three years, such as 21 years.

Lease or licence for any longer definite term (over three years) or indefinite term: annual rent above KES 2,000

This 2% of one year's rent is the highest rent-based lease rate in the Schedule. There is no 3% or 4% band and no band for leases over 21 years. A lease granted in perpetuity is charged as a conveyance on the value of the property instead (s.58).

Premium (or any consideration other than rent) for a lease of immovable property situated in a municipality

Section 57 charges a premium 'as if it were a conveyance on sale'. For immovable property in a municipality, item 12A applies: KES 20 / 40 / 60 / 80 for consideration up to KES 500 / 1,000 / 1,500 / 2,000, then KES 40 per KES 1,000. Charged in addition to the rent-based duty.

Section 57 applies the general conveyance-on-sale rate (item 11): KES 10 / 20 / 30 / 40 up to KES 500 / 1,000 / 1,500 / 2,000, then KES 20 per KES 1,000. Charged in addition to the rent-based duty.

Former nil-duty threshold for annual rent up to RM2,400 (abolished)

Abolished from 1 Jan 2025: tenancies with annual rent of RM2,400 or less are now dutiable at the item 49(a) rates. The Bill's explanatory note says the amendment removes the RM2,400 threshold ('memotong nilai ambang dua ribu empat ratus ringgit') and that the rates also apply to instruments where rent is RM2,400 and below a year, effective 1 Jan 2025. Read from the Bill as tabled (D.R. 48/2024). The gazetted Act text was not reachable (lom.agc.gov.my timed out). LHDN's 30 Jun 2026 guideline shows no threshold.

How the table was checked

Each row was compiled from the official source linked next to it (legislation, regulations or the registry’s own fee schedule) and then checked a second time, row by row, against the same source. Government fees only: agent, lawyer and notary fees are not included. Fees change, so open the official source before you file.

  • Kenya: item 21 charges duty on one year's rent (rate or average rate), not on total rent for the term, except for terms up to one year, where it is charged on the whole amount payable. The Act's wording overlaps for a term of exactly one year ("not exceeding one year" / "not less than one year"). There is no urban/rural or county split for rent; the municipality (4%) / elsewhere (2%) split applies only to a premium, under s.57 and items 12A/11. A lease in perpetuity is charged as a conveyance on the value of the property (s.58). The text was read from the Kenya Law consolidation (dated 1 July 2026); KRA's assessment practice was not separately checked.
  • Malaysia: the item 49(a) rates (RM1 / RM3 / RM5 / RM7 per RM250 for terms up to 1 year / over 1 to 3 / over 3 to 5 / over 5 years or indefinite), the removal of the RM2,400 nil-duty threshold, the RM10 minimum duty (s.36CB) and the new s.47A penalties all took effect on 1 January 2025. They were read from the Finance Bill 2024 as tabled (D.R. 48/2024) and confirmed against LHDN's current guideline and FAQ. The gazetted Finance Act 2024 and the AGC consolidated Stamp Act were not reachable on the check date (lom.agc.gov.my and federalgazette.agc.gov.my timed out), so the Act number is not given. Self-assessment (STSDS) covers lease and tenancy instruments from 1 January 2026 (Phase 1). Stamping goes through e-Stamp Duty (e-Duti Setem), reached via MyTax or stamps.hasil.gov.my with a STAMPS ID. The STAMPS portal was not shut down. LHDN's FAQ notes that no penalty applies for an incorrect BNDS during the first year of STSDS.
  • Singapore: rates apply to leases executed on or after 22 February 2014 without a premium. Leases with a premium pay conveyance (BSD) rates on the premium and are not tabulated here.
  • Left out: Kenya temporary occupation licences (item 21(4), tied to repealed land statutes), Malaysian leases of movable property, and Singapore premium leases.
  • Rates change, usually through annual Finance Acts. Check the source before stamping. Reference data, not legal advice.
