This Salon Booth Rental Agreement (the "Agreement") is entered into on [Effective Date] by and between:

[Owner Name], operating the salon located at [Owner Address], [Owner City], [Owner Province] [Owner Postal Code], Canada, email: [Owner Email] (hereinafter referred to as the "Salon Owner"), and

[Renter Name], with a mailing address at [Renter Address], [Renter City], [Renter Province] [Renter Postal Code], Canada, provincial trade licence/certificate number [Renter Licence Number], email: [Renter Email] (hereinafter referred to as the "Booth Renter").

WHEREAS the Salon Owner operates a salon at the above address and has booth space available for rental;

WHEREAS the Booth Renter is a licensed beauty professional who wishes to rent booth space to operate as an independent contractor and serve their own clientele;

WHEREAS both Parties intend this arrangement to be a commercial lease of space and not an employment relationship;

NOW, THEREFORE, in consideration of the mutual promises and obligations set forth herein, the Parties agree as follows:

PREMISES. The Salon Owner hereby leases to the Booth Renter the following booth space within the salon: [Booth Description]. The Booth Renter shall use the booth exclusively for the provision of personal care services as described herein and for no other purpose.

PERMITTED SERVICES. The Booth Renter is authorized to perform the following services at the salon: [Permitted Services]. The Booth Renter warrants that they hold a valid provincial trade licence, certificate of qualification, or equivalent credential as required by the applicable provincial cosmetology, hairstyling, or barbering regulatory authority, including Skilled Trades Ontario, the Industry Training Authority of British Columbia (ITBC), Alberta Apprenticeship and Industry Training, or the equivalent body in the Province of [Province]. The Booth Renter shall maintain valid licensing and certification at all times during the term of this Agreement.

TERM. This Agreement shall commence on [Start Date] and shall continue on a [Term Type] basis. [Term Length]. If this is a month-to-month arrangement, either Party may terminate this Agreement by providing [Termination Notice] days’ written notice to the other Party.

RENT. The Booth Renter shall pay the Salon Owner a monthly booth rental fee of CAD $[Rent Amount] (the "Rent"), due on the [Rent Due Day]. All payments shall be made by [Payment Method]. A security deposit of CAD $[Security Deposit] (the "Security Deposit") shall be paid upon execution of this Agreement. The Security Deposit shall be returned within thirty (30) days of the termination of this Agreement, less any amounts owing for unpaid rent, damages, or other charges. If the Rent is not received within five (5) business days of the due date, a late payment fee of CAD $[Late Payment Fee] shall apply.

UTILITIES AND SHARED AMENITIES. The following items are included in the Rent: [Included Utilities]. The Booth Renter shall be responsible for their own products, tools, equipment, and supplies required to perform their services. The Booth Renter shall keep the booth and shared common areas clean, tidy, and in compliance with all applicable municipal health and safety bylaws.

INDEPENDENT CONTRACTOR STATUS. The Booth Renter is an independent contractor and NOT an employee of the Salon Owner. The Booth Renter shall set their own schedule, pricing, service offerings, products, and techniques. The Salon Owner shall not direct or control how the Booth Renter performs their services. The Booth Renter is solely responsible for all federal and provincial income taxes, Goods and Services Tax (GST) and/or Harmonized Sales Tax (HST) registration (if applicable under the Excise Tax Act), Canada Pension Plan (CPP) self-employment contributions, and any other statutory obligations to the Canada Revenue Agency (CRA). The Salon Owner shall not make any payroll deductions from the Rent or any payments. The Salon Owner shall not issue a T4 slip; if the Booth Renter pays rent, the arrangement constitutes a commercial lease.

INSURANCE. The Booth Renter shall maintain, at their own expense, commercial general liability insurance with a minimum coverage of CAD $[Renter Insurance Amount] per occurrence and professional liability (malpractice) insurance appropriate to the services performed. [Include Additional Insured]. The Booth Renter shall provide proof of insurance to the Salon Owner upon execution of this Agreement and upon each renewal. The Salon Owner shall maintain their own premises liability insurance covering the common areas and building structure.

HEALTH, SAFETY, AND SANITATION. The Booth Renter shall comply with all applicable federal, provincial, and municipal health and safety legislation, including the Occupational Health and Safety Act (Ontario), Workers Compensation Act (British Columbia), Occupational Health and Safety Act (Alberta), or equivalent provincial statute. The Booth Renter shall maintain sanitation and sterilisation standards as required by the local public health authority and the applicable provincial cosmetology regulations. All chemical products used by the Booth Renter must be stored, handled, and disposed of in accordance with the Hazardous Products Act (R.S.C., 1985, c. H-3) and the Workplace Hazardous Materials Information System (WHMIS 2015).

CLIENT RECORDS AND OWNERSHIP. The Booth Renter shall build and maintain their own client list and records. All client information collected by the Booth Renter is the exclusive property of the Booth Renter. The Salon Owner shall have no claim to the Booth Renter’s client records or personal data. The Booth Renter shall comply with the Personal Information Protection and Electronic Documents Act (PIPEDA, S.C. 2000, c. 5) and any applicable provincial privacy legislation with respect to client personal information.

TERMINATION. Either Party may terminate this Agreement by providing [Termination Notice] days’ written notice to the other Party. The Salon Owner may terminate this Agreement immediately without notice if the Booth Renter: (a) fails to pay Rent after five (5) business days’ written notice; (b) operates without a valid provincial trade licence or certificate; (c) violates health and safety regulations; (d) engages in conduct that materially harms the reputation of the salon; or (e) commits a material breach of this Agreement that is not cured within fourteen (14) days of written notice.

LIABILITY AND INDEMNIFICATION. The Booth Renter shall indemnify and hold harmless the Salon Owner from any claims, damages, losses, or expenses arising from the Booth Renter’s services, products, or conduct, including claims related to personal injury, allergic reaction, or property damage caused to the Booth Renter’s clients. The Salon Owner shall indemnify and hold harmless the Booth Renter from any claims arising from the condition of the salon premises, including structural defects or common area hazards.

SIGNAGE AND BRANDING. The Booth Renter may display their own business name, business cards, and promotional materials at their booth station, subject to the Salon Owner’s reasonable approval regarding size and placement. The Booth Renter shall not alter the exterior signage of the salon without the Salon Owner’s prior written consent.

GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the federal laws of Canada and the laws of the Province of [Province]. Any dispute arising under or in connection with this Agreement shall be submitted to the courts of the Province of [Province].

ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between the Parties with respect to the booth rental described herein and supersedes all prior negotiations, discussions, representations, and agreements. No amendment to this Agreement shall be valid unless made in writing and signed by both Parties.
