This Pet Sitting Contract (the "Contract") is entered into on [Effective Date] by and between:

WHEREAS the Pet Owner wishes to engage the Pet Sitter to provide care for the pet(s) identified herein during the Pet Owner’s absence;

WHEREAS the Pet Sitter represents that they have the experience, skills, and ability to provide responsible and attentive care for the pet(s);

NOW, THEREFORE, in consideration of the mutual promises and obligations set forth herein, the Parties agree as follows:

PET INFORMATION. This Contract covers care for the following pet: [Pet Name], a [Pet Species], age [Pet Age], weight [Pet Weight], colour and features: [Pet Colour]. Microchip or tag number: [Pet Microchip]. Known medical conditions or allergies: [Pet Medical Conditions].

SERVICE PERIOD AND TYPE. The Pet Sitter shall provide [Service Type] from [Service Start Date] to [Service End Date]. The Pet Sitter shall exercise the standard of care that a reasonably prudent person would exercise in the care of their own pet of similar species, breed, and temperament.

CARE INSTRUCTIONS. The Pet Sitter shall follow the care instructions provided by the Pet Owner:

Feeding: [Feeding Instructions].

Exercise: [Exercise Instructions].

Special instructions: [Special Instructions].

VETERINARY CARE AND AUTHORIZATION. The pet’s regular veterinary clinic is [Vet Name], located at [Vet Address], telephone [Vet Phone]. The Pet Owner hereby authorizes the Pet Sitter to seek emergency veterinary treatment for the pet if the Pet Sitter, in their reasonable judgement, determines that the pet requires immediate medical attention and the Pet Owner cannot be reached. The Pet Sitter is authorized to approve veterinary expenses up to CAD $[Vet Auth Limit] without the Pet Owner’s prior consent. Expenses exceeding this amount require the Pet Owner’s approval, except in life-threatening situations. The Pet Owner is responsible for all veterinary costs incurred during the service period.

ANIMAL WELFARE. The Pet Sitter shall provide care in compliance with the Criminal Code of Canada (R.S.C., 1985, c. C-46), Sections 444 to 447, which prohibit causing unnecessary pain, suffering, or injury to an animal, and the applicable provincial animal protection legislation, including the Ontario SPCA Act, 2019, S.O. 2019, c. 13, the Prevention of Cruelty to Animals Act (British Columbia), R.S.B.C. 1996, c. 372, the Animal Protection Act (Alberta), R.S.A. 2000, c. A-41, or the equivalent statute of the Province of [Province]. The Pet Sitter shall ensure the pet has access to adequate food, water, shelter, exercise, and veterinary care at all times.

PAYMENT. The Pet Owner shall pay the Pet Sitter a fee of CAD $[Fee Amount] [Fee Type] (the "Fee"). Payment is due [Payment Due]. All payments shall be made by [Payment Method]. If the Pet Sitter is a registered GST/HST registrant, the applicable Goods and Services Tax (GST) and/or Harmonized Sales Tax (HST) shall be added to the Fee.

CANCELLATION. The Pet Owner may cancel this Contract by providing at least [Cancellation Days] days’ written notice before the service start date for a full refund. Cancellations with less than [Cancellation Days] days’ notice shall be subject to a cancellation fee equal to fifty percent (50%) of the total Fee. If the Pet Sitter cancels without cause, the Pet Sitter shall provide full refund of any amounts paid and make reasonable efforts to assist the Pet Owner in finding alternative pet care.

LIABILITY. The Pet Sitter shall be liable for any injury, illness, or death of the pet caused by the Pet Sitter’s negligence or wilful misconduct. The Pet Sitter shall not be liable for injury, illness, or death caused by pre-existing conditions, the pet’s own behaviour, or circumstances beyond the Pet Sitter’s reasonable control. The Pet Owner shall be liable for any injury or property damage caused by the pet to the Pet Sitter or third parties. The Pet Owner warrants that the pet has no known history of aggression toward humans or other animals unless disclosed in writing.

INDEPENDENT CONTRACTOR. The Pet Sitter is an independent contractor and not an employee of the Pet Owner. The Pet Sitter is solely responsible for all federal and provincial income taxes, Canada Pension Plan (CPP) contributions, and any other statutory obligations. Nothing in this Contract creates an employment, agency, partnership, or joint venture relationship between the Parties.

PRIVACY. The Pet Sitter shall comply with the Personal Information Protection and Electronic Documents Act (PIPEDA, S.C. 2000, c. 5) and any applicable provincial privacy legislation with respect to the Pet Owner’s personal information. The Pet Sitter shall not share the Pet Owner’s address, contact information, access codes, or other personal data with any third party without the Pet Owner’s prior written consent, except as required for emergency veterinary treatment.

GOVERNING LAW. This Contract shall be governed by and construed in accordance with the federal laws of Canada and the laws of the Province of [Province]. Any dispute arising under or in connection with this Contract shall be submitted to the courts of the Province of [Province].

ENTIRE AGREEMENT. This Contract constitutes the entire agreement between the Parties with respect to the pet sitting services described herein and supersedes all prior negotiations, discussions, representations, and agreements.
