4. HDB SUBLETTING CONDITIONS

The parties acknowledge that: (a) This room rental is subject to HDB’s subletting approval, which must be obtained by the Flat Owner before the tenancy commences; (b) The Flat Owner must continue to reside in the flat throughout the subletting period; (c) The maximum number of occupants in the flat (including the owner and tenants) must not exceed the HDB occupant cap (6 for 3-room and larger; 4 for 2-room); (d) The tenant must be registered with HDB via the HDB Resale Portal within 7 days of commencement; (e) Short-term rentals of less than 6 months are not permitted; (f) The tenant must hold a valid long-term immigration pass (Employment Pass, S Pass, Work Permit with at least 6 months remaining, Dependent Pass, or Long-Term Visit Pass); (g) Non-Malaysian foreigners are subject to the applicable quota.

What Is a HDB Room Rental Agreement (Singapore)?

A HDB Room Rental Agreement in Singapore sets out the rental terms, deposit, duration, and obligations agreed between landlord and tenant.

HDB's regulatory framework for room rental imposes specific conditions that differ from private property tenancy law. Under HDB's subletting policy, flat owners may rent out bedrooms only after obtaining HDB's written approval through the HDB e-Service portal. The flat must have completed the 5-year Minimum Occupation Period (MOP) from the date of key collection. The flat owner and at least one other registered occupant must continue to reside in the flat throughout the subletting period — a flat owner living alone cannot sublet any bedrooms. The maximum subletting period approved by HDB is 3 years per approval cycle, subject to renewal.

HDB imposes a Non-Citizen (NC) Quota at the block and neighbourhood levels, limiting the proportion of non-citizen tenants in each HDB block. Flat owners intending to rent to non-citizen tenants (including Employment Pass, S Pass, and Work Permit holders) must check the NC Quota availability for their block through the HDB e-Service portal before entering into a room rental agreement. If the NC Quota for the block is reached, the flat owner cannot rent to additional non-citizen tenants until the quota has available capacity.

The minimum tenancy period for HDB room rental is 6 months — HDB does not approve subletting for periods shorter than 6 months. Maximum occupancy limits also apply: HDB sets the maximum number of tenants based on flat type — for example, a 3-room flat can accommodate a maximum of 6 persons (including the flat owner's household), a 4-room flat can accommodate 6 persons, and a 5-room or Executive flat can accommodate 9 persons. These limits are enforced by HDB to prevent overcrowding, which is an offence under the Housing and Development (Overcrowding) Rules.

Stamp duty under the Stamp Duties Act (Cap. 312) is payable on HDB room rental agreements, administered by the Inland Revenue Authority of Singapore (IRAS). The tenant is typically responsible for stamp duty payment, though the agreement may allocate this differently. Stamp duty must be paid within 14 days of executing the agreement for documents signed in Singapore.

The legal framework for HDB room rental also intersects with the Personal Data Protection Act 2012 (PDPA, No. 26 of 2012). Singapore's Community Disputes Resolution Act 2015 (CDRA), administered through the Community Disputes Resolution Tribunals (CDRT), provides a statutory mechanism for resolving neighbour disputes arising from room rental arrangements, including excessive noise, interference with common areas, and other conduct that unreasonably interferes with the enjoyment of the premises.

When Do You Need a HDB Room Rental Agreement (Singapore)?

An HDB Room Rental Agreement is needed whenever an HDB flat owner rents out one or more bedrooms to a tenant while continuing to reside in the flat.

Flat owners with spare bedrooms seeking rental income must execute a written room rental agreement before the tenant moves in. HDB requires flat owners to apply for subletting approval through the HDB e-Service portal, and the approval application requires submission of the tenancy agreement details including the tenant's particulars, rental amount, and tenancy period. Without a written agreement, the flat owner cannot obtain HDB approval, and unauthorized subletting constitutes a breach of the flat's terms and conditions — potentially leading to compulsory flat acquisition by HDB under the Housing and Development Act.

Foreign workers in Singapore — including Employment Pass holders, S Pass holders, and Work Permit holders — frequently rent HDB rooms as their primary accommodation. Their employers may require a copy of the tenancy agreement for work pass renewal purposes, and the Ministry of Manpower (MOM) may request evidence of the foreign worker's residential address. A formal room rental agreement satisfies these documentation requirements.

Students attending Singapore's universities and polytechnics (National University of Singapore, Nanyang Technological University, Singapore Management University, Singapore University of Technology and Design, and the polytechnics) commonly rent HDB rooms near their campus. Flat owners who are Singapore Permanent Residents (SPRs) can sublet rooms under the same conditions as Singapore Citizen flat owners, provided all other eligibility conditions are met. However, SPR flat owners should note that HDB may impose additional conditions on subletting approval for SPR-owned flats.

What to Include in Your HDB Room Rental Agreement (Singapore)

Tenant details must include the full legal name, NRIC or FIN number (for foreign tenants), passport number, nationality, and contact information. For tenants holding work passes, the work pass type and expiry date should be noted — the tenancy period should not extend beyond the work pass expiry without provision for early termination.

Room and shared facilities description must identify the specific bedroom being rented (e.g., master bedroom, common room), whether the tenant has exclusive use of an attached bathroom or shares common facilities, and the common areas accessible to the tenant (kitchen, living room, laundry area). Restrictions on use of specific areas or appliances should be stated.

Rental terms must specify the monthly rent in SGD, the payment due date, accepted payment methods (bank transfer via PayNow, GIRO, or cash), and the consequences of late payment. Rental amounts for HDB room rentals in Singapore typically range from S$500 to S$1,500 per month depending on the flat location, room size, and furnishing level — rooms in mature estates near MRT stations command higher rents.

Security deposit — typically one month's rent for a one-year tenancy and two months' rent for a two-year tenancy — must be stated, along with the conditions for its return (deductions for damage beyond normal wear and tear, outstanding utility charges, or early termination).
