A Pet Custody Agreement in New Zealand records the care and ownership arrangements for a companion animal between the parties, consistent with the Contract and Commercial Law Act 2017.

New Zealand's Animal Welfare Act 1999 is the primary legislation governing the welfare of animals, including companion animals. The Act imposes obligations on all persons in charge of an animal to meet the animal's physical, health, and behavioural needs across five domains: nutrition, environment, health, behaviour, and mental state. A Pet Custody Agreement should be consistent with these welfare obligations and should prioritise the companion animal's wellbeing when allocating care responsibilities.

For dogs specifically, New Zealand law imposes additional registration and microchipping obligations. Under the Dog Control Act 1996, all dogs must be registered annually with the territorial authority (local council) in whose area they reside. Under section 36A of the Dog Control Act 1996, dogs must be microchipped and the microchip registered on an approved database such as the New Zealand Companion Animal Register (NZCAR). Wellington City Council, Auckland Council, Christchurch City Council, and all other territorial authorities in New Zealand require annual dog registration, and the responsibility should be clearly allocated.
