CAREGIVER INDEPENDENT CONTRACTOR AGREEMENT
This Caregiver Independent Contractor Agreement ("Agreement") is entered into on [Agreement Date] between:
(1) [Client Name], of [Client Address], Tel: [Client Phone] ("the Client"); and
(2) [Caregiver Name], of [Caregiver Address], Garda Vetting Reference: [Garda Vetting Reference], PPS/Tax Ref: [Caregiver PPS] ("the Caregiver").
1. INDEPENDENT CONTRACTOR STATUS
1.1 The Caregiver is engaged as an independent contractor and not as an employee, worker, or agent of the Client. Nothing in this Agreement shall be construed to create a relationship of employer and employee.
1.2 The Caregiver is responsible for their own income tax (self-assessment), PRSI (Class S), and USC under the Taxes Consolidation Act 1997. The Client shall not deduct or remit PAYE, employee PRSI, or any other statutory deduction on behalf of the Caregiver.
1.3 The Parties note that Irish Revenue and the WRC may re-characterise this engagement as employment if the working arrangements point to an employment relationship in substance, regardless of the label in this Agreement.
2. CARE SERVICES
2.1 The Caregiver agrees to provide the following care services to [Care Recipient Name] ("the Care Recipient") at [Care Location]:

2.2 Services shall commence on [Start Date].
2.3 The agreed care schedule is: [Care Days], [Care Hours].
2.4 The Caregiver shall carry out the Services in a professional, compassionate, and skilled manner, in accordance with the standards reasonably expected of a competent caregiver and in compliance with all applicable Irish legislation, including the Health Act 2007 (care standards) where applicable.
3. GARDA VETTING
3.1 The Caregiver confirms that they have been Garda vetted through the National Vetting Bureau (NVB) under the National Vetting Bureau (Children and Vulnerable Persons) Acts 2012–2016, and that the vetting disclosure (Reference: [Garda Vetting Reference]) disclosed no matters that would preclude the Caregiver from working with vulnerable persons.
3.2 The Caregiver agrees to immediately notify the Client if any new information comes to their attention that would affect the outcome of their Garda vetting.
4. FEES AND PAYMENT
4.1 The Client shall pay the Caregiver [Hourly Rate], payable [Payment Frequency] on submission of an invoice or timesheet.
4.2 The Caregiver shall maintain accurate records of hours worked and submit them to the Client with each invoice.
4.3 All fees are exclusive of VAT. If the Caregiver becomes VAT-registered, the applicable VAT rate shall be added to invoices.
5. TERM AND TERMINATION
5.1 This Agreement takes effect on [Start Date] and continues until terminated in accordance with this Clause.
5.2 Either Party may terminate this Agreement by giving [Notice Period] written notice.
5.3 Either Party may terminate this Agreement immediately if: (a) the other Party commits a material breach; (b) the Caregiver's Garda vetting is revoked or adverse information comes to light; or (c) the health or safety of the Care Recipient requires it.
6. CONFIDENTIALITY AND DATA PROTECTION
6.1 The Caregiver shall keep all information about the Care Recipient and the Client strictly confidential, both during and after the term of this Agreement.
6.2 The Caregiver shall process personal data (including health data) relating to the Care Recipient solely for the purpose of providing care services, in accordance with the GDPR (EU) 2016/679 and the Data Protection Act 2018. Health data is a special category of personal data under GDPR Article 9 and shall be handled with the highest level of care.
7. GOVERNING LAW
This Agreement is governed by Irish law. Disputes shall be subject to the jurisdiction of the courts of Ireland.
