However, the tenancy agreement may provide for a longer notice period. Additionally, for a statutory periodic tenancy (i.e. one that arises automatically at the end of a fixed term), the common law rule requires that the notice expire on the last day of a period of the tenancy.
The Renters' Rights Act 2025, which received Royal Assent on 27 October 2025, will convert all existing fixed-term ASTs to periodic tenancies from 1 May 2026. After that date, tenants will be able to end their tenancy by giving two months' notice, regardless of when the tenancy was entered into.
A Tenant Notice to Vacate should be in writing and should clearly state: the address of the property; the tenant's name; the date the notice is given; the date by which the tenant will vacate the property; and the tenant's signature. It is advisable to keep a copy and to serve the notice by a method that provides evidence of delivery — for example, hand delivery with acknowledgement, recorded post, or email (if the tenancy agreement permits email notice).
The notice does not end the tenancy automatically — the tenant must actually vacate the property, return the keys, and comply with all end-of-tenancy obligations (including cleaning, restoring the property to its move-in condition, and paying any outstanding rent or charges) before the tenancy is formally over and the deposit process begins.

End of fixed term — not renewing: Where a tenant does not wish to renew or extend their fixed-term tenancy, they should give written notice to the landlord before the end of the term. Moving to a new property: Whenever a tenant plans to move to a new property, they must give their current landlord proper notice. Failure to do so means they remain liable for rent until the notice period expires, even if they have moved out.
Leaving a joint tenancy: Where a tenant wishes to leave a joint tenancy, they must obtain the agreement of their co-tenants and the landlord, as serving a notice to quit by one joint tenant will in some circumstances end the tenancy for all joint tenants under the rule in Hammersmith & Fulham LBC v Monk [1992] AC 478. Mutual agreement to end early: Where the landlord and tenant have agreed to end the tenancy early by mutual consent (surrender), a written Tenant Notice to Vacate combined with the landlord's written acceptance constitutes a valid surrender by operation of law.
